Appeal set for ex-Chelsea selectwoman Carole Swan

BOSTON (AP) — A panel of judges in Boston is set to hear oral arguments in an appeal by a former Maine selectwoman serving an 87-month prison term for federal extortion and fraud.

The Kennebec Journal reported (http://bit.ly/1IYLRdS ) the U.S First Circuit Court of Appeals is scheduled to hear arguments for 57-year-old Carole Swan’s appeal on Sept. 11.

The former Chelsea selectwoman’s appeal alleges Kennebec County sheriff’s deputies made a mistake by not reading her Miranda rights during an interview in which she confessed to part of a crime.

Swan was convicted in 2013 of extortion for using her position to seek kickbacks from a contractor who plowed the town’s roads.

She also was convicted of workers’ compensation fraud and income tax fraud.

Federal prosecutors say the appeals court should reject Swan’s claim.
