Scott L. Ackley, 41, of 51 Depot St., is accused of shooting Sharon Demayo, 38, after an argument at the home they shared. He faces charges of domestic violence assault, aggravated assault and domestic violence reckless conduct.

Demayo is at Central Maine Medical Center in Lewiston.

According to an arrest affidavit by Detective Randall Keaton of the Maine State Police, Demayo was shot in the face below her left nostril. The bullet exited near her jaw. The affidavit said police responding to the call arrived at the Buckfield home at 5:28 p.m. Monday to find Demayo sitting on the porch.

She told police that she and Ackley had been fighting over the gun and believed she may have shot herself in the struggle, the affidavit reads. Ackley told police it was an accident and that he didn't know the gun was loaded.

The affidavit said Demayo's son, Jesse Demayo, told investigators that his mother and Ackley had returned home and were drunk. He said there was a physical altercation between the two, and that Demayo ran to her bedroom and came back with her gun. He said Ackley punched her in the face and took the gun, but that she kicked him in the leg. Ackley then shot her in the face, the boy said.

According to the affidavit, Demayo and Ackley said they believed her finger was on the trigger when it went off. When speaking to police, Ackley was told that the trajectory of the gunshot wasn't consistent with his statement. Ackley said he was very drunk at the time of the altercation, and Keaton wrote, “Ackley stated that if we were telling him he had shot Demayo then he probably did.”

Police recovered a black 9mm Beretta pistol from the home. Ackley was released on bail at 3:30 p.m. Wednesday. His arraignment is set for July 1 in Oxford County Superior Court in Paris.
