Ivey denied hearing before recall election

PARIS — The chairman of the Board of Selectmen, who is subject to a recall election on Monday, said Friday that he was refused a public hearing to defend his time on the board.

David Ivey said he went to the town office Friday to ask for a public hearing the same day, but was denied. Town Manager Philip Tarr confirmed that Ivey requested a public hearing, and said that it would have been impossible to fulfill the request under the guidelines of the ordinance.

Ivey said he should have received a hearing under the ordinance, which states that a selectman subject to recall may request a public hearing "at any time between the time of ordering the recall election and the date of said election." The ordinance also says the Board of Selectmen would have to schedule a hearing to take place not fewer than seven days before the election with at least seven days of public notice before the hearing.

Ivey said he was not getting "due diligence" under the ordinance since he requested a hearing prior to the election. He also criticized the ordinance as "poorly crafted."

Tarr said the section of the ordinance could be "confusing," but that adequate scheduling and notice would have to be given before such a hearing. He said that it would also be impossible to call an emergency selectmen's meeting to address his request since Ivey would potentially have to recuse himself based on conflict of interest, Selectman Glen Young is on vacation, and Selectman Troy Ripley has resigned.

"If he wanted a hearing, it should have been brought in here or brought to the Board of Selectmen at least 15 days before the vote," Tarr said.

A petition calling for Ivey's recall was submitted in November, less than a week after the recall ordinance was passed at a referendum vote. It stated that signing residents had "lost confidence" in Ivey.

One of Ivey's more controversial actions was voting with the majority in a 3-2 decision in June to terminate former Town Manager Sharon Jackson's contract with the town. Several residents have regularly attended the selectmen's meetings since that decision and publicly criticized Ivey. In addition, Jackson has filed a lawsuit against the town appealing her termination and accusing Ivey, Young and Ripley of having clandestine meetings to decide to fire her.

Ivey denied that any such meetings took place, and said Jackson's contract allowed termination at any point with or without cause.

"I might have made some people angry, but I didn't do anything wrong," Ivey said. "I did everything right by the book. That's why I didn't resign."

A little birdie told me that

A little birdie told me that the turnout has been pretty good so far today! Including the absentee ballots (@ 275 or so) and today's voters as of early evening, approximately 600 residents have voted and the polls have one more hour (don't know how many showed up from 4:30pm to now) to go! Way to go Paris! We honestly don't know how tonight's vote will end (who will stay who will go), but we are thrilled that people are coming out to make their voice known. Wonderful!

 

By the way, if you're not going to be in town on Friday, you can still vote via absentee ballot at the Paris Town Office before Friday if you want.

I don't understand, if he if following the law in his request for a hearing, why isn't the election being rescheduled?  The law says he is entitled to that?

I don't know about due diligence, but isn't he still entitled to due process?

Where does it say he is allowed "due dilligence"????  Here is where it tells the time frame that he is allowed to request a hearing.... Straight from the "Law"

D.  Hearing

If at any time between the time of ordering the recall election and the date of said election the official whose recall is being sought requests a public hearing, the Selectmen shall promptly schedule such a hearing to occur not fewer than 7 days before the election, and shall provide adequate posting at least 7 days before said hearing.

Also.... if you have read and understand the Ordinance.....

E.  The Result of Election

In the event of an affirmative vote for removal, such vote shall take effect upon the recording of the vote tabulation into the records. 

In other words..... Bye, Bye, Ivey.... You are done tonight!

When Ivey served as

When Ivey served as a Selectman in the town of Oxford he purchased a house in South Paris. Although he moved into that house, he attempted to keep his position as an Oxford Selectman by declaring himself homeless! He thought by doing so he would be able to retain his position in Oxford. Guess he couldn't figure out that he actually needed to live in the town he was serving! Homeless = no permanent address. Needless to say, he had to give up his position as an Oxford Selectman.  

Ivey refused to call a special meeting of the selectman to accept Troy Ripley's resignation. Now, he feels he's not getting "due diligence" because he was denied the opportunity to a public hearing for the same day as his request?!?  Hard playing by the rules isn't it? He might have been able to manipulate Thorne when he acted as interim Town Manager, but looks like Tarr is going to make him follow the rules!

Ivey will do & say anything to keep the title Selectman. Please vote "Yes" to recall David Ivey on February 1.

It says "MAY" and Ivey didn't schedule no hearing prior to HIS Recall Election nor did he take any action 7 days or more prior to his scheduled recall election.

Playing games again!

As Chairman he's had plenty of time (since November 2009!) to call a public hearing on this issue and he could have received a public hearing being the CHAIRMAN and demanded it, but didn't.

BECAUSE WE THE PEOPLE OF THE TOWN OF PARIS CANNOT TRUST WHAT WILL HAPPEN AFTER THE FEBRUARY 1ST AND FEBRUARY 5TH RECALL ELECTIONS ARE OVER AND WHAT DIRTY TRICKS MIGHT BE PLAYED, YOU MUST CHECK "YES" OR "NO" AFTER EACH SELECTMEN ON THE BALLOT SO THERE IS NO QUESTION ON WHAT YOU MEANT AS A VOTER.

I will be voting "yes" to recall Dave Ivey and "no" to not recall Skip Herrick on the February 1, 2010 recall election and I will be voting "yes" to recall Troy Ripley (can't trust his "resignation" at this point!) and "no" to not recall Ray Glover on the February 5, 2010 recall election.
