Former jail worker appeals court ruling

PORTLAND — A former corrections worker who was fired for engaging in duct-tape and chokehold pranks at the jail and later sued the county for wrongful termination is appealing an Androscoggin County Superior Court judge's decision to dismiss the suit.

Gorham, a corporal at the Androscoggin County Jail in Auburn, was fired after surveillance cameras showed him involved in two pranks at the jail last year while on duty. One of the pranks involved duct-taping a fellow worker to his chair. In another prank, he put a co-worker in a chokehold.

An Androscoggin County Superior Court judge ruled in May that Gorham's appeal was not filed in time for the court to hear his complaint.

Gorham was required to file his appeal of the Androscoggin County Commission — which voted 2-1 to fire him — within 30 days of learning about his termination, that judge ruled. Gorham attended the commission's Nov. 4 meeting where the votes were cast. He filed his lawsuit challenging his firing on Dec. 18.

Attorneys for the commission were successful in seeking to have the suit dismissed before going to trial.

In court documents, an attorney for Gorham outlined the issues for his appeal.

Shawn Sullivan, a lawyer based in Concord, N.H., wrote that the high court should decide whether the lower court mistakenly relied upon a 1985 zoning case involving the town of Kennebunk.

Sullivan also wrote that he would ask the court to consider whether the lower court erred in failing to find that Maine's Freedom of Access Act required the County Commission to issue a written statement and findings of fact outlining the reasons for an employee's dismissal.

Sullivan is expected to ask the high court to decide whether the county court made a mistake when it dismissed Gorham's claim of federal due process under the circumstances in which the appeal process “was inadequate to address the full scope of relief requested by him.”

The lower court judge concluded that Gorham had pursued the proper legal mechanism, even if he didn't specifically cite it in the complaint filed with the court. But, using that mechanism, the suit was untimely, the judge wrote in his decision.

Sullivan had argued in the lower court that Gorham should have had 30 days from the date of the commission's written decision and findings of fact, recorded on Nov. 18, to file his appeal.

In his lawsuit, Gorham complained that his due process rights were violated under the U.S. Constitution.

The firing stemmed from two incidents.

In one, he and other corrections officers bound a fellow worker to his chair using duct tape. The chair was wheeled with the worker in it into a prisoner transport elevator and sent to another floor before he was returned and freed himself.

In another incident, Gorham put a fellow worker into a chokehold. Afterward, that worker lay his head on his desk repeatedly and complained he was disoriented and nauseous. The worker said he consented to Gorham's actions.

Oral arguments before the high court have not yet been scheduled.

Accountability is job one!

Why are you so quick to excuse this idiot? He acted like an 6th grader while trusted by the taxpayers to guard the jail, he got caught, and now he's blaming everyone else. Instead of accepting responsbility for his personal decisions, he's blaming everyone else and trying to turn this into a mega-payday. It used to be that if you did something stupid and got caught, you were embarassed and dishonored. Now everyone is excused and coddled and treated like a victim. GROW UP! This idiot should be accountable for his own decisions and his own actions.

Hung? No. But the firing was appropriate. This man doesn't know how to behave on the job and he's not likely to change. I'll be angry if they bring him back in there. He's not safe.

Okay... I do not agree with what Gorham did, it was kinda dumb but I do not think he should have lost his job for it. He was part of the union which he payed a weekly fee to help protect his job... there are steps that are suppossed to be taken with disciplining an officer for those types of actions and they bypassed all of them. This is not the first time ACJ has done this to one of their employees with even lesser evils. Gorham should have been disciplined ei... suspension w/o pay, demotion, counseling ect. Everyone makes mistakes some bigger than others... but that does not mean they should be hung for it.

He was part of the union which he payed a weekly fee to help protect his job... there are steps that are suppossed to be taken with disciplining an officer for those types of actions and they bypassed all of them. Sorry to Disappoint

Sorry Bill, but I've never duct taped a law enforcement officer at my job.
There's a big difference between endangering other officers in a dangerous work environment and stringing together paper clips in the cubicle next to mine. This was not a harmless prank. (Imagine if a PRISONER had duct taped that guard .... the others would have shot him!)

I was simply trying to make a couple of points. First, everyone plays jokes on others at work. It helps relieve stress. Second, in the second incident (the choking), the choked officer actually asked for Gorham to perform the choke hold on him; that's why he never came forward to make a complaint. As for the comments about "endangering" the inmates and public, that just didn't happen. Inmates are locked down at night and would not have been moving about. As to the comment that an inmate would have been shot had he duct taped a staff member, please remember that the guards are not armed, so no one could have been shot.
"Sheriff" Guy P. Desjardins is mostly to blame for this incident. His claim to "proven leadership in difficult times" is an outright lie. He has never proven himself to the employees or public. His massive over-reaction to this incident is proof. Instead of investigating the incident, he loudly announced his intentions to fire those responsible first. Only later did he decide an "investigation" was appropriate; one that white-washed his original decision. A true Leader would have conducted a thorough investigation to find the actual cause(s) of this incident; staffing, training, competence (or the lack thereof) of the administrators in charge and the supervisors of the staff involved. A true Leader would have found a way to take appropriate corrective action while, at the same time, saving the career of a valuable employee. Instead, Desjardins panicked and, fearful his incompetence would become generally known, opted to fire Cpl Gorham.
I am not condoning the pranks that were played by Gorham and his Sergeant. They were childish and ill-considered at best. But Gorham should never have been sacrificed so that the real culprit, the worthless git we have as a Sheriff, could save himself.
Desjardins; Incompetent, self-centered and a waste of oxygen.

The Sheriff did not duct tape a person to a chair or put them in a choke hold. This guard needs to take responsibility for what HE did. I am sick of excuses. Playing jokes to relieve stress? What kind of place do you work in, because any employee of mine who did either of those things, whether asked to or not, would find his butt on the street, and I'd be suing HIM for the wages he was paid while doing those activities.

after reading a recent Sj article about short-staffing of guards, who are in turn exhausted and burned out from too much work, and 6K in overtime in four weeks that there wouldn't be much time for fooling around at work. just sayin...

DUCT TAPE DEPUTY.

He put the security of the Jail, and the resident tax payers at risk, as well as making a hostile work environment for his subordinates with his "horseplay". With supervisors like him on duty, it's easy to understand how a prisoner died in the "observation cell " in that Jail.

Who was wrong here? The county for firing you? NOPE. The court system for ruling against you? NOPE. It was YOU dumpweed. Maybe if you'd performed your job responsibly and with integrity, you would still be employed. The choice was yours and now you have to live with it. Stop draining the county of money defending its decision to fire your sorry ass --- you had it coming. I hope you lose, and I hope it costs you a million dollars in lawyer fees.
Meanwhile, good luck finding your next job in the classifieds: "Wanted: deadbeat employee who causes trouble with stupid pranks, got fired from his last job, then sued everyone involved. Top pay and benefits to the right candidate."
