Witness: Video captures fatal shooting at Maine VA

AUGUSTA, Maine (AP) — According to a newspaper report, a witness who says he captured the shooting death of Marine veteran James Popkowski on video says the veteran was carrying a rifle pointed down and away from law enforcement officers when he was confronted by them at a VA hospital in Maine.

The 37-year-old veteran had a rare form of leukemia and left the Marines in 2003 with an honorable discharge. On July 8, officers responded to a shot fired at the VA Medical Center in Augusta and confronted Popkowski. Investigators say preliminary information indicated the officers felt threatened. He died of a gunshot wound to the neck.

The Bangor Daily News reported that Paul Stevens of Belgrade says he agreed with the Attorney General's Office to keep the video confidential, pending the outcome of an investigation into the shooting.

Maybe???

You can make up what ever senerio that allows you to sleep at night, but the fact is they shot this Marine to death and quite possibly murdered him. To compare this to the shooting in Columbine is absurd. The state of maine has not found an officer un-justified in a shooting more then thirth years! This will be swept under the rug like the 17 year old who ran from police drunk, he was un-armed and shot in the back, or the guy in the wheelchair that two officers emptied there weapons into! Or the unarmed man that was being pulled over for an OAS only to be shot to death while atempting to flea! When are the citezens of this state going to say enough is enough! And as far as comrade crankbait if you want to live under martial law pack you bags I will pay for the flight back to your motherland!

Vet shooting

I agree that i'ts not a capitol offence to walk away from a cop with a rifle! Like it or not. To shoot anyone for that is NOT justifiable ! In this case, I said it before and I'll say it again. If any veteran wanted those cops or anyone else dead ,They would have been dead. The only justification for this shooting would be if the veteran panicked or was startled and raised and pointed his weapon at the officers ! The tape WILL NOT disappear and the truth will come out ! In any event ,this is lose, lose situation ! whether justified or not the officers will now have to deal with the fact that they were responsible for taking a human life! Anyone who tells you it doesn't effect you whether justified or not has never been in that situation! The veteran who wanted someone to listen to him and help him is dead. This is also another event which shows that Togus V.A. is having trouble meeting the needs of our veterans! NOT do to the workers, but do to program cutbacks and the lack of money! God bless all involved and Welcome to Obama care !!!

"Welcome to Obama

"Welcome to Obama care"

Huh?

Obama has proposed increasing spending for the VA. Bush and the Republicans were negligent in this area.

Where were you a cop Mayville? Its not 1970 it wil never be again..These officers learned from warriors who made the ultimate sacrifice because they didnt act. Would you have let him walk off with a gun. I bet you would have tackled him TJ hooker style. There is nothing you can say that would me any modern day cop think about wat happened. Your old and out of touch no matter what you witnessed. ANYONE can be a witness warriors just choose not to be.

maybe

Maybe he was walking with RIFLE IN A NONRIFLE ZONE looking for squirrels to shoot. Think about it. man with rifle.....place where rifles cant be shot.......not hunting season....already let a round fly........Vetran walking towards VA hospital WITH RIFLE........POLICE YELL PUT DOWN GUN.......IGNORES POLICE BECAUSE HE IS NOT HUNTING,NOT SPORT SHOOTING. HMMMMMMMMMMMMM WHAT WOULDYOU DO IN A SPLIT SECOND WITH ALL YOUR LAW ENFORCEMENT EXPERIENCE.......

(dILLAN kLEABOLD of columbine )IF THE POLICE TOLD HIM TO PUT DOWN THE GUN AND HE JUST WALKED OFF AND KILLED 13 CHILDREN WHO's FAULT WOULD IT BE..........................tHINK ABOUT IT. oh times up someone has been shot.

might not be an offence

it may not be an offence but warrants a reason that can be articulated easily given the totality of the circumstances. Once again monday morning quaterbacks. the must of not looked at their bracelets. WWVD what would veritas do?

I hope there were "copies of

I hope there were "copies of the original video" made by Paul Stevens as a back up. That way if there was tampering with going on... there would still be the "original" proof.
Let me guess, the law enforcement officers are probably on paid leave! And what preliminary information and pending the outcome? Sounds pretty fishy if you ask me.

crankbait's picture

your all nuts

Shot was already fired, he had a gun, ingored police commands, was was his motive when he was walikng away. Ill bet if the po,ice didnt shoot as he walked away with a rifle and killed one of the nasayeers family member you would blame it on the police. WHEN POLICE SAY PUT DEON THE GUN THEY MEAN IT. IT IS A THREAT TO PUBLIC SAFTEY ESPECIALLY AFTER A SHOT HAS BEEN FIRED. GIVE IT UP FOR THE MONDAY MORNING QUATERBAKS WHO WOULD POOP THEIR PANTS RATHER THAN RESOPOND TO A VETRAN WITH A GUN WHO HAS ALREADY POPPED A CAP OFF.

Robert OReilly's picture

So shoot him in the leg,

So shoot him in the leg, shoot the gun out of his hand, don't shoot him in the neck and kill him.
His death was pointless and the cop that murdered him now has to live with that blood on his hands.

BTDT - exercised restraint on numerous occasions and lived to talk about it.

Witness videoVA shooting

I think the video Mr.Stevens has should be released to the public so we can all decide if this was necessary shooting. I hope Mr Stevens shares the video with Mr.POPloskis family because if their are grounds for a lawsuit by his family then they should have this to use in court. Sometimes the police are to quick to make decisions and take a life unnecessarily which in this case I believe was the case. Now a little girl has no fathr and probably is deeply hurt by all this. Someone needs to be held accountable.

A person has to wonder why

The AG wanted to keep the tape secret. If there is no cover-up, then the tape should have been made available to the public immediately. We knew about the tape, but now we have to wonder if it will have been doctored once finally revealed.

Apparently someone is guilty of murder, and the AG's office wishes to cover it up. Inexcusable!

gjaunts's picture

What?

What's there to wonder about? The video is of a man dying. It's presumably a pretty graphic and sensitive video. When was the last time you saw a video of someone getting shot in the neck released to the public by a state agency?

tron's picture

What's to wonder about?

Whether it was a justifiable shooting or murder. I don't trust the AG's office, I prefer to make my own decision. Prosecution will rest with the AG's office, and we know how they'll rule, but I would like to be certain of the absolute truth. Release an unedited version of the tape.

T's picture

You prefer to make your own

You prefer to make your own decision? Based on what? You're doing a complete investigation of what happened? Interviewing all witnesses? You have the forensic skills and material evidence necessary to come come to a valid conclusion?

NO

I hope no one here feels that one can determine a man's intent from a blurry video taken from a considerable distance.

ojhuig's picture

ok

How is talking to the newspaper keeping it confidential? You may be right but you made a promise not to talk about it until the investigation is finished.

Robert OReilly's picture

100 bucks says this tape

100 bucks says this tape never again surfaces and the cops get away with murdering a veteran.

Desired Effect

I suspected before hand, and it seems to be confirmed by earlier reports, that this was suicide by cop. But maybe that's what THEY want us to think! Somebody tosses out a plausible explanation and the masses typically accept it.

Lay odds

Regardless of the circumstances, the police are never found in the wrong in Maine when it comes to this type of situation.
