LEWISTON — An evening of City Council harmony ended with Council President Tom Peters vowing to find a legal way for councilors to circumvent Mayor Larry Gilbert on Thursday.
Councilors were discussing the process for hiring a new city administrator and considering how people should be named to a citizen search committee. They agreed to a 13-member format, including one person selected by each councilor and the mayor.
But Gilbert said he interprets the City Charter differently.
Councilors are free to decide the format for the committee, but he's the
only one allowed to put people on it.
Gilbert said he might name councilors' choices to the committee. But he might not.
"Council, should we do this, figure out a way to get around the mayor?" Peters said. "Is that what we have to do?"
"You don't mean get around the mayor," Gilbert said. "You want to get around the charter."
"No, Larry, I mean around you," Peters said. "You're being obstructionist."
"No, I'm not," Gilbert said.
"Yes, you are," Peters said.
Councilors had called the special meeting
to settle their differences and to decide how to find a replacement for
fired City Administrator Jim Bennett. As of Thursday, the city had received 26
resumes from potential replacements — 12 from Maine and 14 from
out of state. Candidates run the gamut from high school graduates to
those with law degrees.
Councilors had agreed to create a rating system to select the best
resumes and had decided to ask the candidates if they would agree to let
the entire process be open to the public.
"I don't see the harm in at least asking," Councilor Robert Reed
said. "I suspect that most will say no and will want to back out of the
process if make their names public now. But, in the interest of
transparency, we should at least ask them."
Councilors also discussed who should be named to a citizens search committee. That committee would be asked to meet at least seven times over the next month, reviewing resumes and interviewing candidates. The group would ultimately recommend the best candidates to the council, which would decide who to hire.
Councilors finally decided to create a committee of 13. The Androscoggin Valley Chamber of Commerce, the Lewiston-Auburn Economic Growth Council, the Androscoggin Valley Council of Governments, the Lewiston Youth Advisory Council and the Lewiston School superintendent would all name one person to the committee. Each councilor and Mayor Gilbert would get to name one person.
Gilbert said he had a legal opinion from city attorney Martin
Eisenstein that appointing the committee was the mayor's right.
When a citizen asked Gilbert if he would agree to name the councilors' preferences to the committee, Gilbert said he would not.
"I will take their opinions into consideration, but the decision is mine, legally, and according to the charter," he said. "They might want someone on the committee I feel is completely wrong, and that's why the charter is set up the way it is."
Councilors Peters and Reed disagreed.
"I do not see how one person making this decision makes this a transparent process," Reed said. "I think, Mayor, you are a fool if you think you're making the decision on this list is a good idea at this time. I think it will backfire big-time and I don't think the citizens will stand for it."
Councilor Peters said he would look for a way to legally have councilors' choices put on the board. Councilors are scheduled to meet again on this matter on Sept. 3 to finalize the committee members. They hope to meet with the final committee on Sept. 10.

I totally agree with enoch auburn were the ones dead set against consolidating and they have enough of their own problems to bring any of that to our process would out right assenieghn (probably spelled wrong). At this point I say point King larry in his and choose no committee. let the councilors pick it down to 3 or 5 top and hold a council meeting to discuss it and let the public weigh in on it. King larry is the biggest joke there is and as for DA01 your out of your mind and have no clue you tell people on here if they have nothing nice to say to keep quiet well stop blogging on here like your the almighty and know everything cuz you DONT!!!!!!!!!! Oh and by the way (as mentioned in my earlier post) not only should children not serve on the selection committee, but niether should Auburn's Manager Glenn Aho!! If you ever get a chance listen to Nelson Peters' position on Aho being on the committee as stated last evening, do so. It was absolutely a beautifully stated point. At the risk of mincing his eloquent words, I attempt to offer what Nelson Peters said. He stated that our two cities are at times in competition (like it or not) and having Aho who is paid by Auburn, to watch over Auburn's interests, to be placed on the committee to select a Lewiston Manager may cause him to leans towards a candidate that he could best control or at the very least outshine. A very valid and important point. Auburn sure as heck didn't invite Lewiston to participate in the hiring of their City Manager in the past.

JD, Funny but it was the Mayor who broke policy and went to the city attorney for a legal opinion on who got to make the selections. He pointed to the correct portion of the charter and got the answer he needed. Unfortunately, the rules for the city do nto allow him to arbitrarily request legal advice from the city attorney and this is the second time he has done so, the first being having the attorney on hand the ight we voted to have Mr. Bennett removed. In both cases he did not go to th council president which is POLICY and he did not inform members of the council of the request. Bottom line for me is if the mayor continues to hold this position there will be no citizen review panel involved as the entire matter is a council decision, seven of us have to make the final call.
I went into Thursday meeting with a list for all to see of what I thought we needed to accomplish and all seven membvers seemed in agreement that we could follow this protocol and be done in short order. Unfortunately the mayor had his hidden agenda and pulled rank. Too bad he can't see the forest through the trees.
As to Tuesday, my vote was in keeping with the original decision, and with five months left in office it is my duty to find a replacement, however if we go into November and do not have a final decision I will consider asking the elected but not yet sworn in new councilors to be involed in the process, and give some input. Its the fair way to go. If the new council does not like the decision than they can terminate the new person, but that new person will not have the golden parachute we recently saw if I have anything to say about it. It is my sworn job to do according to the CHARTER that some love to quote when it suits their needs.

Mayor Gilbert didn’t write them, Tom Peters didn’t write them yet they have to follow them. The council should follow the charter. The council still has more power in the matter, as in the end they are the only ones to vote on the hiring.

KD, much as I try, I cannot find an argument against what you say, but its a bit heavy when you start insinuating corruption - I lived in Auburn growing up so I saw little of Lewiston law enforcement and therefore would not have a clue as to what was happening on this side of the river. We have a charter, then we have policy rules and procedures and then we weigh that against a contract specifically written for ones employment and that waives certain pieces of the charter provisions. One of the things we were told originally by mr. bennett was that because we were 7 new councilors, he actually expected our legal fees to be higher than normal and budgetted accordingly. I've got to give him credit for calling that one correctly, and the MAYOR needs to stop asking for all these opinions without getting approval of the council, per the rules.
Please keep in mind that while Mr. Gilbert had a hidden agenda, I laid mine out for all to see and asked that they simply keep the steps ion mind so we could do the work in a thoughtful and deliberate manner. I never saw it coming with what King Larry did, given all the positive dialogue Tuesday once we decided we would have a search process.
I am struggling to figure out which way to go now - do we just have the seven council members do the review and exclude the public and the mayor or do we allow him to hand pick the group - knowing he'll allow a few but will stock it with political favors.

Robert , the councils oath was sworn to the citizens , not the mayor. Dont struggle too much to decide which way to go. Remember where your loyalties should be. To the mayor or to the citizens. As far as corruption accusations go, maybe it is heavy handed but King Larry pushing so hard to get his hands in the councils decision making process makes the average joe say HMM. He should not be allowed to inject his political influences or favoritisms into the councils process to choose admin. Remember the charter entrusts the council with this decision and its process. Allowing GIlbert to wedge himself in there would not be following the charters outline. If the charter wanted the mayor to be involved in the hiring process , it would be written so. Giving King Larry the ability to stock the hiring pool with his choices is only going to keep people looking for the violations of sec 8.04 of the charter and keep the real issues from being addressed. If the council will not wait to let the next council fill the position, then the council should NOT let Gilbert run the system amuck. Narrow down the pool and hold a meeting to ask for input by the public for the types of individual they want to see in the position, take it to heart, and make a choice. As far as applicants not wanting thy're current employers to know they applied. Only offer credentials to the public for review. leave names out of it . Public can choose the applicant of choice by credentials not by name. (ie ..Applicant 1,2,or 3)man ,woman ,race,color. all these should not matter for us to choose. its about what they can offer the city.

Just let the councilors recommend committee members to the mayor. Let him appoint (as the charter states) and move on. In the end the council will vote where the mayor does not get a vote. It's obviously a balance of power that was put forth when the charter was originally written. This is the way it has been done with every other ad-hoc committee.

I think Larry was out of line when asking Denis to have the lawyer check into the Charter without the consent of Phil Nadeau and the members of the City Council. And when Denis was aked he said, it was early 6am when he recieved the email "clearly not thinking" maybe no coffee yet and Phil was out of the office. Poor decision making and shows who is in Larry's pocket. All members should have been informed before the lawyer was contacted. My opinion

The Mayor is correct and Peters, et.al., are wasting their time trying to "find a way around the Charter." The Charter is The Charter--get over it, people. If the City Council doesn't like the fact that the Mayor is exercising his authority to appoint people to the Advisory Committee, then let's not have an Advisory Committee to appoint them to.

Well Robert it looks like the only way to get the mayor out of the equasion is to disband the commitee. But this does not mean the council cannot hear from the citizens. Maybe the council should narrow down the applicants to 3 to 5 people and then let the sun journal post who they are , what they're qualifications are, and then have a town hall meeting for all those who wish to be heard to voice they're recommendations for who gets the job. Ultimately the charter said nothing about the mayor having the power to form a commitee to circumvent the councils job or authority to hire an administrator. I read it and my oppinion is that if King Larry thinks his power to appoint a commitee overrules or trumps the councils duty to hire administrator, He is abusing the charter and creating a scenario/situation that stops the council from completing they're duty as written in the charter. Is this behavior covered under ground for dissmissal of mayor? If the mayor is trying to undermine the council then he is blatantly NOT acting in the best interest of the citizens.

Here's a quick thought - having a citizen committee will in fact slow down the process through its natural actions. If we suddenly eliminate them than not only will we speed up the process but we'll look like its intentional. This process needs to be transparent, we need input and we want to hear from the citizens, but we must weigh that against confidentiality of the applicants, most of whom will go back to their job at the end of the process. They may not want their employer to know they are actively seeking a greater opprtunity. I went into last night with a plan to get us started, laid out some basic concepts and said use this as a draft to keep you thinking...it was working until we got to the appointment issue. We had 7 counsilors all facing the same direction, some more vocally than others but all in agreement - isn't that what our city needs to see right now, regardless of how anyone feels about individuals?
The good news is 26 candidates and still 2 weeks left to apply. While I didn't see names or resumes yet, 6 with masters and city manager experience speaks volumes that we can find a qualified individual to manage the day to day affairs of this city.

DA first of all they mayor appoints to the committees yes all the city councilors is asking that he pick from a list that all the parties put together not from the mayors own liking which I feel is extrememly fair. For tom peters to find a way around it is looking out for the best interest of the city and not the power hungry mayor. ALL the councilors are in agreement with it not just 1 or 2. If the mayor is going to be this way I say dont make a committee and let the councilors do the hiring as THE CHARTER says is there job and the mayor has nothing to do with.

The Charter does say that the mayor is the only member of the council that can appoint to an ad-hoc committee (which this one is) I guess each councilor can recommend a member for the committee to the mayor and then he is the only to appoint. So he is right. Anything else would be a violation of the city charter. For Tom Peters to "find a way around the charter" would be a violation. I would play by the rules. Neither party wrote the charter. It was written long before any side was elected. So the mayor is just following the rules.

Do we think the mayor would agree if each councilor gave him a handful of possible appointments and he got to pick from that group? That seems like a fair compromise. If not, the council could just vote to disband the committee (as disrespectful it might be to it's members).
And to everyone arguing against an LYAC member on the board, what would it hurt? How many of you have commented on these blogs that there is nothing for kids to do in the city? The LYAC was created to serve as an ADVISORY (It's in their name!) to the city council on youth needs. Most are responsible young adults, and deserve as much a voice as anyone else.

Larry Gilbert did not write the charter,and he's not in violation of it.this saga mimics the justice system.Ex cop v.s lawyer.larry is trying to follow the law,and the lawyer is trying to circumvent the law.The charter is very specific about the mayors powers. The problem is mikec that gilbert has his own personal agenda for who he wants as the new administrator he wants to go back to the old ways when lewiston politics were a thousand times more corrupt. He wants someone in there that is a yes man. Let the public and councilors decide the new administrator that way you have such a diversity of input that NO ONE can play favoritism on the matter. I for one am soooo sick of gilbert he screwed up and corrupted the lewiston police department when he was chief and he is screwing up the city as mayor. Gilbert just sit back and hush and listen to the people you took the oath to represent they are telling you to do it THEIR way NOT yours.

Can gilbert get any more arrogant????? Im sorry but seems to me that the remaining councilors are doing what the TAXPAYERS want not their own agenda not the mayors agenda but wat WE taxpayers want. I think the council needs to have Tom Peters find a way around the mayor so that OUR voices are heard and abided by not the mayors personal agenda. I commend Mr. Reed and the other councilors for agreeing together and sticking to their guns to FINALLY go by how the constituants want.

I think we all know where Larry "the Bird" should put his Charter. I believe in the Charter it is there for a reason, but you should make use of it correctly. I have to say that Larry's use of emailing Denis "Mean" Jean to have the lawyer look into his dictatorship was a sheisty move. I think if we give Larry anymore power you will start seeing piles of books burning in the streets of Lewiston. You damn well know Larry knew about his ability of choosing the committee. This was one of his biggest pet peeves back when Guay was Mayor. I was at the meeting last night and Larry was really nervous at most of the meeting. I could see his hand shaking by his face alot of the times and it was because he knew he was on thin ice. You know when Larry is treading water his face gets redder than it naturally is and his hand trembles by his cheek. I thought it was great!! The only way I'll gain any respect for Larry is if he dresses up as a female like Gulliani did when he was Mayor.

Enoch you couldn't have expressed my feelings any better. The show was quite entertaining they are always good for a laugh. It was nice to see the council not being Gilbert's puppets the only cowards were Poulin and Theriault. I hope that Peters can find a legal way to let them form their committee without Gilbert's input. It always amazes me that Gilbert always reverts to the city charter when it serves him personally, he seems to ignore it when it doesn't. As far as a minor on the committee let's pick people who are citizens of Lewiston and registered voters.
It really scares me to think that Gilbert will be representing the people of Lewiston in France. My father is from France and visits yearly. I would not want them to think that all people of Lewiston are idiots. Larry please do not use your canuck French there, cause they will laugh you out of the country!!!

This council (mayor included) does not seem to be acting in a professonal manner. I agree that to name a minor to this committee is not in the best interest of the City; there is a need for life experience here. That being said, the City charter is what should govern the naming of appointees. If the mayor is correct so be it; anyone not happy with this should amend the charter. Unfortunately we have grown ups acting in a very childish manner here. This is not anything new in local politics and is not limited to Lewiston. Hopefully some day this will stop and Lewiston can have a council to be proud of. It also looks like the council is trying to shield itself from criticism in the process of reviewing candidates and their qualifications. They should not do this; they are elected to make decisions for the City. They decided to terminate the previous manager and they have the responsibility to choose the new replacement. The new manager should also be willing to take the job serving at the pleasure of the council without a "golden parachute". A manager's job is tenuous at best and is known to be a very political position. Those that choose this career should be willing to live with it's conditions.

All Mayoral candidates in the upcoming election are happy today. Gilbert did the best job ever of showing the world why he shouldn't be Mayor. Thanks Larry! (p.s. please make sure you are very vocal in supporting your buddies Reed, Theriault and Poulin during your next campaign). If you missed this, you need to see it, catch the Saturday rebroadcast.
I have never seen such a display of pompus arrogance as Gilbert showed during this latest go round with the Council, his attitude, body language, sour puss facial expressions, all shone at 100% during his latest bold and blatant quest to be the ultimate center of power. Even his buddy Reed was so aghast... he had to try and reason with Gilbert to no avail, thus I'm sure, impairing his relationship with this rather derelict ally of his.
That said it was even more amusing to see Denis Theriault and Larry Poulin who you could see all but had to agree that Gilbert was being a total jerk, but their alliance to him was such that they cowered and did not vocalize it directly as all the others did. These two aligned themselves with one disturbed individual, and now the benfits of that bond are really going to produce a bitter result.
Gilbert was so bad that even Tina Baily spoke up, and very politely admonished Gilbert for being a total butt head, as did Baily, who wasn't quite as polite!!
Tom Peters and Nelson Peters said eveything I was saying at home as this unfolded, maybe even more. I am so sorry that these two have to work with this bunch.
Lastly, the notion of putting a minor, Cub Scout, Boy Scout, Youth Advisory person on this City Administrator selection committee is absurd. Stop with the political correctness already, you folks on the Council need to do a lot of other things to undo the damage and keep yourselves from being historically know as one of the most highly educated and dysfunctional Councils ever known to this City.
