Transient faces charges after burglary, assault

LIVERMORE FALLS — A man is accused of forcing his way into a residence on Fayette Road late Thursday and punching the owner, police said.

Marvin Capen, 43, listed as a transient, was arrested early Friday on charges of felony burglary and misdemeanor domestic assault and assault, Livermore Falls police Chief Ernest Steward Jr. said Monday. A conviction on the burglary charge is punishable up to five years in prison.

Capen was released on $1,060 cash bail on Friday, according to a corrections officer at the Androscoggin County Jail.

Apparently Capen and the owner of the residence had a telephone conversation about an incident that happened in the past, and then Capen appeared at the Fayette Road home, Steward said.

Capen is accused of grabbing the owner by the throat and punching him two or three times, he said.

The victim refused medical treatment, Steward said.

Capen is scheduled to appear on Dec. 2 in Androscoggin County Superior Court in Auburn.
