Court orders dog that killed therapy dog to be euthanized

LIVERMORE FALLS — A Lewiston judge ordered a Livermore Falls man Tuesday to have his dog euthanized by Nov. 24, for attacking and killing a therapy dog in July on lower Park Street.

Jack, a Jack Russell terrier, was being walked on a leash by its owner's children when the bull mastiff-mastiff-Rottweiler mix named Hooch attacked him near the larger dog's residence at 46 Park St.

Martin Vining, 41, pleaded guilty in 8th District Court to civil violations of having a dog-at-large, having an unlicensed dog and being owner/keeper of a dangerous dog, Animal Control Officer Wayne Atwood said Friday.

Vining was ordered to pay $450 in restitution, a $100 fine for the unlicensed dog violation and a $250 fine for the dangerous dog violation, Livermore Falls police administrative assistant Amanda Leclerc said.

The judge ordered that the dog be euthanized by Wednesday, Nov. 24, and ordered a copy of the euthanization papers to be sent to the Androscoggin County District Attorney's Office by Tuesday, Nov. 30, Atwood said.

Vining was not available for comment Friday.

“On Nov. 16 justice was carried out for the death of our beloved Jack,” owner Bethany Miller of Livermore Falls said Friday. “It is my hope that our town will be a safer place to be because of Jack's story. We would like to thank the Livermore Falls police, Mr. Atwood and the District Attorney's Office for the respectful way they handled our case. I feel bad for Mr. Vining and Hooch but the public's safety had to come first.”

Jack was Miller's therapy dog. She said previously that she and her family were devastated when Jack, 4, was killed. She had planned at the time to get counseling for her children, ages 14 to 19, who had to watch the attack. Attempts made to separate the dogs were unsuccessful and the smaller dog died during the incident.

Miller's biggest concern then was that she didn't want to see anybody else get hurt by the larger dog.

Hooch had also attacked a mailman in 2007. Vining was charged then with owning a dangerous dog.

Miller’s children and Jack were returning from a walk at the Livermore Falls Recreation Field and were about a half-mile from home when Hooch came around a corner near Vining's home.

Her son, Kyle Wilson, 19, said previously that Hooch gave his younger brother, Jordan Gill, 14, a look and Jack took a step toward the larger dog, and Hooch attacked it.

Vining said previously that he was outside burying another of his dogs that had been hit by a vehicle and had to be put down. Hooch was not on a leash at the time but was initially with Vining and a friend in the yard.

"Nothing was done on purpose," Vining said at the time. He didn't know why Hooch went after the smaller dog, he said, but he knew Hooch, who was 9 at the time, didn't get along with Jack.

Recently a deaf man and his assistance dog were attacked on Falmouth St in Rumford. Witnessse' calls for help to police and ACO were ignored, no one responded. The offending dog still runs loose all the time there. Best to stay away from that area.

Service dog attacked twice in Rumford, NO HELP

My sister and her service dog were attacked twice in Rumford by dogs running at large. The first time six good samaratans came to her aid but not before $5000 in damage where done to my sister and her service dog. The police where called and responded about an hour later. The animal control officer never showed her face, just asked my sister to write a statement and submit bills. It was known who the dog belonged to but, my sister was unable to get the animal control officer to even find out if the dog had been vaccinated against rabies! The dog was not licensed. This required that my sister's service animal receive additional vaccinations even though she was current and my sister to undergo treatment. The cost for all the medical and veteraniary care was over $5000. The owner of the dog was not properly charged and not ordered to pay the damages. My sister also lost the use of her service animal which under state and federal law the owner of the attacking dog is obligated to pay for. Because the ACO did not do her job, my sister was stuck with those expenses as well.

A few months later my sister was attacked again. This time the attacking dog attached itself to my sisters leg! Luckily she wears leg braces of riggid plastic that incase most of her lower legs and protected her from what otherwise would have been a very serious injury. She called the police who referred her to ACO with the dog attached to her leg! The ACO returned her call with the dog still attached to her leg. The ACO said, "could you please just write out a statement and drop it at the PD?" My sister gritted her teeth said YES and hung up. She thought, I could, but do you think I will waste my time and do it? Not a chance. She continued alone, struggling to free herself from this vicious dog attack eventually kicking it under the lower jaw with her other foot hard enough it let go and ran off.

Don't expect dog attacks to let up anytime soon. Irresponsible dog owners in Maine know they have nothing to fear from the bad behavior of their dogs or their irresponsible actions. There is an old saying, "If you can't do the time, don't do the crime." Well in Maine, there is no risk of "time" (or fine) for keeping a viscious dog or letting a dog run at large so there is no "time" (fine) to fear for committing either of these crimes.

Another sad story of two dogs

Another sad story of two dogs losing their lives, because of an ignorant owner. I feel so bad the Jack's family:*( And also I feel bad for Hooch, who ultimately lost his life because his owner was too ignorant to take the necessary steps to ensure something like this would not happen. After the mailman incident, the owner should have made sure this would NEVER happen again. Which means you get the necessary training and guidance to help your dog. Dogs dont just act this way, to act this way. It breaks my heart to hear of dogs being put down all because of their owners.....I encourage anyone who is having problems with their dogs from small behavior problems to being aggressive towards other dogs or people, to contact the Dog Rehabilitation Center of Maine. These people are absolutely amazing, and have turned around many, would be euthanized, dogs and rehabilitated them into wonderful loving family dogs. Please do not let your dogs fate turn into the fate of hooch. RIP Jack, poor little guy. Also, RIP to Hooch.

I am sorry but I have to

I am sorry but I have to disagree. I feel for Jack's family. But after the mailman incident Hooch should have been put down. I have never seen an aggressive dog change even with the right owner and obedience training. I have been bitten by a so-called rehabilitated dog living with a loving family. I had done nothing to provoke the dog. That dog was put down after it bit me, the owner learned his lesson in taking "rehabilitated" dogs and will never do it again. I am my grandfather's granddaughter you don't keep a dog that attacks for no reason. you humanely put it down. I just hope Hooch's owner does not ever get another dog.

Sorry but i have to disagree. You my friend, are exactly what ignorant is. Dogs can be rehabilitated, with the right guidance. I have seen many dogs that were trained fighting dogs, fought in the ring, know exactly how to kill and have the ability to do so, and they are now calm submissive, well balanced dogs. So say what you want, but you have no idea what you are talking about.

I am so sorry for the lady who was attacked so viciously by such a dangerous dog. It's one thing to have a dog like this, if you keep it chained, but to let it roam free is unforgivable, not to even mention against the law!. And why, oh why, do people want these sorts of dogs. Do they prove the owner's manliness? Shame on you Martin Vining!! Maybe you never have a moments peace for the rest of your life!

He should also be restricted from ever owning another dog. Wait and see, I guarantee before long he'll have another dog that he'll abuse until it's mean.

This is a very sad sorry. All folks need to care for their dogs and keep them safe because they depend on us (their owners) for this. They are at our mercy and deserve good care and love. Jack was well cared for, Hooch not so much. It also saddens me to see dogs staked out in their yard next to their dog house. I drive by 2 houses, in the town where I live and see the 2 same dogs, staked outside by their dog house. They are out there day or night, day in day out, rain or shine. There are always many cars at these houses but the dogs are always outside looking and waiting for a chance to come in or someone to come out and play and pay some attention to them. Each time I pass by I want to stop and pet these dogs. I often tell my husband maybe we could take them home for the day and let them play with our dog. Dogs are social animals and want to be part of the family. I shudder to think about how they will make it as the weather turns cold and the snow begins to pile up. I don't want to judge but I wonder why people get dogs and then leave them outside, never bringing them in to warm up and be part of the family??? I have a large dog and she is an inside dog. We love her very much and wouldn't have it any other way. Please people, love and enjoy your dogs, protect them and others from them. All dogs are entitled to love and care. They depend on us, their owners for that. Please people, care for your dogs, and all animals. They deserve it!!!

This is a very sad

This is a very sad story....not one, but 2 dogs will be dead. Owning a pet is a huge responsibility. Why people chose to have pets then let them run the streets, is not understandable to me. I have owned dogs in the past, and they were house dogs. ( both were big dogs ) When they went out to do their business, they were on a runner. When they were out in the yard with us, they were on their runner, or a long leash. ( even though they both responded very well to voice command ) I now have a cat, and she too is a house cat. She will not be allowed to roam the neighborhood and risk fleas, ticks, skunks, and the worst..being hit by a vehical. She is part of my family...not something to just 'own' and say I have. Jack sounds like he was well cared for and much loved. Hooch, may have been a loved pet, but was not cared for properly.
A sad story all around...
