JAY — Selectmen will hold a special town meeting Monday, Dec. 20, to see if voters want to sell two strips of town land to abutters of the Stone Street Baseball Field.

The meeting begins at 6 p.m. at the town office and will be followed by a regular selectmen's meeting.

Selectmen learned Nov. 22 that several property owners on Oak Street and one on Stone Street that abut the town-owned field had structures built or installed over the town property line.

Those structures, according to officials, are 2 to 16 feet over the town's property line. The board gave several property owners who were not interested in buying town land until June 2011 to get the structures off the land.

Richard “Babe” and Mary Binette had a buyer for their house but a mortgage survey showed that a shed was about 3 feet on town property. The couple cannot sell the property unless the title is clear, they said. They want to buy a strip of land 10 feet wide by 150 feet long.

Suzanne Czarbecki wants to buy a strip 10 feet wide by 175 feet long. She said it would cost more to move a pool fence than to buy the property. She bought the property three years ago and the fence was already there.

The Binettes and Czarbecki are required to split the cost of having the special town meeting which was estimated to cost a total of $125.

The cost to Czarbecki for her strip of land would be about $1,000.

Both property owners also need to pay a surveyor about $800 each for the legal documents, surveying and other related expenses.

Cushman said Wednesday that Russell and Sarah Bernard of Stone Street want to donate the shed that is on town property to the town. Selectmen will consider that request Monday as well.
