Norway man charged with obstruction, disorderly conduct at fire scene

NORWAY — A 69-year-old man is accused of throwing a beer can at a police officer and disrupting firefighters as they extinguished a blaze behind his house.

Donald R. Cummings called authorities when a sauna, not attached to his house, caught fire Wednesday evening at about 5 p.m. After a scuffle with firefighters and police, Cummings was arrested and charged with obstructing government administration and disorderly conduct.

According to Paris Lt. Michael Dailey, once firefighters arrived, Cummings became angry with their response time.

“I guess the response was longer than what he thought was necessary, but he lives well out of town,” Dailey said. Cummings lives at 63 Jackson Lane.

Norway firefighters requested police assistance. Paris police responded because the Norway police were busy.

“When we got there, the Norway fire chief (Dennis Yates) basically said the homeowner was intoxicated; he was being hostile toward the firefighters,” Dailey said.

According to Dailey, alcohol was “definitely an issue” in the incident.

Dailey said police found Cummings leaning against a firetruck, holding a beer. Paris officer William Cook approached Cummings and asked if the truck was his. When Cummings said it wasn't, Cook told him to stop leaning on the truck.

Dailey, reading from Cook's arrest report, said Cummings became unruly, swore at Cook and threw a beer can at him.

Norway Assistant Chief Jim Tibbetts said it was a small chimney fire in which the stovepipe went into the chimney, and that firefighters acted quickly enough to save most of the sauna. He said the building was about 12 feet by 16 feet.

“(The fire) was contained to right in the very corner where the chimney was,” Tibbetts said.

Cummings was booked at Oxford County Jail at around 6:40 p.m. by officer Cook, and bailed on $200 shortly afterward. Obstructing government administration is a Class D offense, punishable by up to 364 days in jail; disorderly conduct is a Class E offense, punishable by up to six months in jail.

Get a life!

Honestly, all of you people really don't have a clue. These police officers have to prepare for the worst case scenario. They have received a call of someone that is being hostile to the firefighters. The police have a job to protect themselves and the firefighters as well as the community. Leaning up against a firetruck with a beer in hand is a problem. It is also very disrespectful to those trying to help you. I am sorry that the officers had to deal with someone of this caliber. Your all a bunch of liberals and you don't see the other side. Their jobs are to react accordingly. Officer Cook was not being a egotistical cop...He was responding to a hostile call!!!! Get with the times people there has been a lot of shooting involving cops. If you feel that they did something wrong you clearly were not there. I am proud of all the Paris Officers as well as all the officers in the surrounding towns. Their training allows them to do as they need to with all kinds of different situations. Maybe Don shouldn't of been drinking and being hostile to the firefighters. Job well done by all the firefighters, Officer Cook and Lt. Dailey!!! They have to be a certain way to go home to their loving families!!!!!!!

A big rush is what the cop got from doing this they were in the guys yard ( his sand box ) and brought there cars and trucks I am sure the fire police were all wound up that there was no traffic to direct down near the pond maybe one of Donkey wheats Durham bulls....and someone probably came with a hazmat pack to clean any gas spills, they all were there yessur mister..but nothing to do so they made themselves something to do by going after the wound up home owner.......can you imagine how defensive all these people were with there" late response time" and this guy being pi**** at them when they fin******* Leaning up against a fire truck 1 year in jail and two years probation... NEXT CASE PLEASE

Who is this "they?"

Who is this "they" you speak of who are supposed to get him the help he needs.. Presumably at 69 he should be responsible for his own needs and actions. If he doesn't recognize a need for AA who is going to force him into it? Seems like the response was appropriate. He called for help, then tried to hinder them from doing their job. Now he will suffer the consequences. Perhaps, in the future he will act a little more responsibly. If not, he may find there will be more consequences to deal with.

I would hate to see them throw this man in jail...He was wrong in what he did, and there are consequences. I believe that if this man had been sober none of this would have happened. I just hope that if he can't be a responsible drinker then perhaps AA could give him the tools he needs to stop drinking. I'd rather see the courts order him to seek help from AA if they find this to be beneficial to Mr. Cummings...I believe it's better than going to jail at sixty-nine years of age.

Donnie needs AA as bad as I need a vasectomy. I know him and he is not an alcoholic, a socially responsible drinker--yes, but not a drunk needing help. And when you say he was wrong, were you there? I wasn't so I will not prejudge, but please don't render your verdict until the trial has been held.

After reading all these posts regarding this unfortunate situation, it sure would be nice to see it resolved with Donnie Cummings and Officers Daily and Cook sitting in the rose garden with President Obama, sipping a beer together and letting bygones be bygones. Please, court system, spare us tax payers the expense of a trial and Donnie the expense of an attorney for an unfortunate misunderstanding.

It was officer Cook who started the mess by being a wise ass and asking Donnie if the the fire truck was his and told him to get off from it . I know Donnie and he pays taxes in this country and probably in this county, so maybe the part of the truck he was leaning on belonged to him as much as it did to officer Cook. Somebody besides Donnie was in a bad mood that day and if officer Cook had been more polite the incident may have been avoided.

Excuse me people

The man had a scuffle with the fire fighters and the police. The fire chief contacted the police because Donald R. Cummings was intoxicated and he was being hostile toward the firefighters. Cummings then swore at the officer and threw an open beer at him. The man deserved being arrested. I for one am glad the officer told Cummings to get away from the firetruck. The man had no business leaning against it.

Sir, if you really think that

Sir, if you really think that someone should be arrested for leaning against a fire truck, you have a real problem with reality. I never knew those firetrucks were so fragile and could be damaged by leaning on one. Special note, it seems that Cummings threw the beer can AFTER being told (in a menacing way I'm sure) to stop leaning against the truck. Sounds to me like the cop started the confrontation with some typical "I am the PO PO (aka God) don't mess with ME!" attitude!

I have no problem

I have no problem obeying the law. When a police officer or a fireman asks you to do something, I guess you do it. These men were there to help him, not to fight him. He was interfering with them doing their job. If your house catches fire you don't stand around the firetruck. These men have a job to do. Cummings threw a beer at an officer...period. There was no excuse for that sort of behavior.

not a drunk

I've lived in the next house up our camp road from Donny Cummings for 11 years. On hot summer days Donny occasionally stops by my house and we'll have a cold beer or two and swap stories about our military days, but never in these past 11 years have I seen Donny intoxicated. I have no idea either about what lead Donny to act as they say he did. It just seems totally out of character for a man I consider a close friend and who has always conducted himself like a gentleman and a good neighbor.

Glad to hear the defense

I'm glad someone is speaking in defense of this man. I read too many stories where I fear the news gets blurred and made to look very incorrect, often ruining the reputation of people. I am a big supporter of our officers and firefighters and I don't blame them either. But it seems more is missing to the story.

Oh My...Is Right...

This man was "leaning against a firetruck"...A Paris Officer asked this man "Is this truck yours?"..Well obviously...there's a fire at this man's home and the "firetruck" wasn't "his"..Why would this officer ask him to stop "leaning" against the firetruck to begin with?...This is what provoked the man in this story...none of us know if he has a problem with "alcohol"...They say he was being "hostile" towards the firefighters when they got there...Where were the EMT's in this story?..Maybe if someone was there to talk to this man, it wouldn't have gotten out of hand...I have made note to self that if I ever have a fire at my home NOT to lean against there trucks b/c apparently it is not an acceptable thing to do..rolls eyes...

Oh my....

Liquor causes alot of people to do some crazy things. I know the police did their jobs...yet, I still feel sorry for this poor old soul. I hope they get him the help he needs. Perhaps without the beer running through his veins, he might have acted differently. I believe a good AA group would be better than jail time.
