Family files lawsuit in sexual abuse case


PARIS — The family of an 11-year-old Rumford girl has filed a lawsuit against an 85-year-old man who admitted last year to sexually abusing her.

The lawsuit was filed in the Oxford County Superior Court against O.B. Willie Rose of North Valley Road in Roosevelt, N.J. Rose was indicted in November of 2007 on four counts of gross sexual assault and 10 counts of unlawful sexual contact. He was accused of abusing the girl in September and October of 2007 after briefly moving to Rumford.

Rose pleaded guilty in January of 2009 to four counts of unlawful sexual contact. His sentence was deferred for a two-year period, during which time he must have no contact with the girl, her family, or children under the age of 16. If Rose successfully completes the term, he may withdraw his plea and admit to a single misdemeanor count of unlawful sexual touching.

The family, represented by attorney Edward Dilworth, says Rose was negligent and had “a duty to exercise reasonable care with regard to physical contact” with the girl. Dilworth says the family has suffered personal injuries, medical expenses, pain and suffering, and other harm. The suit asks for compensation and any other relief the court determines to be applicable.

Dilworth is also seeking a $175,000 attachment order against Rose’s property and financial accounts. He says the family is likely to recover judgment in the case equal to or greater than that amount.
