DOVER-FOXCROFT, Maine (AP) — A Maine woman tearfully recalled finding her mother’s battered body with a plastic bag over her head in the trial of her uncle, who is charged with murder.
Testimony resumed Thursday in the trial of 54-year-old Michael Toby. He has pleaded not guilty by reason of insanity in the death of his 70-year-old sister, Rosalie Shedd.
Toby is accused of beating his sister with a piece of wood, strangling her with a vacuum cleaner cord and putting a plastic bag over her head during a fight in 2008 in the apartment they shared in Dover-Foxcroft.
The Bangor Daily News says Shedd’s daughter testified in a Dover-Foxcroft courtroom Wednesday that when she found her mother’s lifeless body, she was tempted to rip open the bag “because I wanted her to breathe.”
