AUBURN — Two brothers who live locally were convicted Friday of charges stemming from the assault of two men outside a CVS store on Union Street last summer.
Jesse McGehee, 31, and Joel McGehee, 29, of 33 Washington St. admitted guilt to related charges in Androscoggin County Superior Court.
Jesse McGehee was charged with aggravated assault, a felony, and violation of condition of release. He pleaded guilty to the latter charge, a misdemeanor, and to a new charge, misdemeanor assault. The felony was dismissed.
He was sentenced to four days in jail on the violation of condition charge. On the assault charge, he was sentenced to 270 days in jail with all of that sentence suspended, except for four days. The sentences will be served simultaneously.
After his arrest, McGehee spent four days in jail, which was credited to his sentence.
He also will be on probation for a year. He was fined $300 for the assault and must pay $435 in restitution to the victim.
He's forbidden from having contact with the two victims.
Joel McGehee had been charged with aggravated assault, a felony, and a misdemeanor charge of criminal use of a disabling chemical compound (pepper spray.)
He pleaded guilty to the misdemeanor as well as a new charge of reckless conduct, a felony.
The aggravated assault charge was dismissed.
If McGehee stays out of trouble for a year, he'll be allowed to withdraw his plea on the felony charge and plead to a charge of misdemeanor assault. He'll go to jail for seven days and pay a $300 fine. He'll also have to pay $1,226.50 in restitution to one of the victims.
If McGehee were to violate the terms of his deferred disposition, he would be sentenced on the felony charge, which is punishable by up to five years in prison and up to a $5,000 fine.
Police said the assaults took place in July 2012 in the entryway of the CVS store at Union and Court streets.
They said the McGehee brothers knew their victims, who were taken to a local hospital with non-life threatening head injuries. A wooden club, believed to be the assault weapon, was recovered.
