Estate of murdered pregnant woman sues employer

AUBURN — The estate of a woman murdered in 2007 by a fellow worker at a Lewiston call center is suing that company, claiming it failed to recognize her assailant's history of violence, especially against women.

The lawsuit, filed in Androscoggin County Superior Court, says Affiliated Computer Services Inc. should have known that Richard Dwyer posed a threat to women because he was on federal parole at the time he was hired. Dwyer had been released from prison only a few months when he was hired to work at the company's Lewiston office.

Dwyer was a "multiply-convicted felon, having previously been convicted of unlawful sexual contact and twice for armed robbery; (he) had had his federal parole revoked for a gross sexual assault," the civil complaint says. He had been found guilty of several other assaults on women, which were given as reasons for revocation of his federal parole.

ACS had a duty to protect its workers, mostly women, from someone with a criminal history of violence toward women, the suit says.

When he was hired, Dwyer "posed an immediate and foreseeable threat to the personal safety of women with whom he might come into" contact, the suit says.

If it didn't, the company should have had a pre-screening process in place to prevent someone with Dwyer's criminal record suggesting a "propensity for violence in general and violence toward women in particular" from working there, the suit says.

Dwyer was convicted of robbing, raping and murdering Donna Paradis, who was in her last term of pregnancy at the time of her slaying. Dwyer had approached her at their Lewiston Mall office on East Avenue where they worked on the same account. After repeated efforts to befriend her, Dwyer told her he'd arranged for her to buy a used car.

She withdrew cash from her credit union and met with Dwyer later that day on Oct. 23, 2007. Police said he strangled her and buried her body in a shallow grave behind the Promenade Mall on Lisbon Street.

The complaint says ACS was negligent in hiring Dwyer. It also claims ACS was negligent not to fire him or discipline him after another female worker complained before Paradis' murder that Dwyer had assaulted her.

In late 2006, Dwyer started harassing the other female worker and repeatedly changed work stations to be closer to her, the suit says. He wrote a sexually suggestive message to that woman, who complained to her supervisor. Her complaint was ignored, the suit says.

He sexually assaulted the woman on ACS property, when their offices were located in Bates Mill No. 2. The woman physically repelled Dwyer's attack, according to the suit.

She filed a complaint against Dwyer with ACS's human resources department. She was told later that nothing could be done about her complaint and was accused of lying about the assault, the suit says.

As a result of Dwyer's actions, Paradis' estate alleges ACS was negligent in its failure to supervise him and put him in a position "where he could and did" kill Paradis.

Paradis experienced conscious suffering when Dwyer killed her, the suit says. The Office of the Chief Medical Examiner for the State of Maine determined that Paradis' strangulation didn't cause her to die instantly. Instead, she would have had several minutes of "intense conscious suffering" at the hands of Dwyer.

The estate is seeking judgment against ACS for the benefit of Paradis' two children, Jeannette Kontos and Sasha Paradis, who suffered emotional distress, loss of services, instructions, advice, counsel, parental training, care and guidance, assistance and protection of their mother as well as the loss of their mother's attention to their physical, moral and educational welfare.

The estate also incurred expenses for Paradis' funeral and other services related to her death.

The suit seeks punitive damages against ACS because "the negligent hiring, retention and supervision of Dwyer, resulting in the foreseeable, unreasonable risk of harm to its female employees was so outrageous that malice towards its female employees by ACS is implied," according to the complaint.

Contacted by phone Thursday, Chris Gilligan, a spokesman for ACS, said the company's legal staff had not seen the complaint and, for that reason, could not comment on it. The company has 21 days to respond to the complaint, a court clerk said.

If he would have been in jail for robbing the Big Apple this would NOT have happened. Suing the employer is one thing, but for the people that are supposed to "serve and protect" to NOT serve notice to the public and employer that this guy is dangerous and NOT protect us from harm is scary . How many other Richard Dwyers are out there that we don't know about. WAKE UP........ AND SOMEONE PLEASE ASK THE DEPARTMENT WHY!!!!!
He was only charged with the robbery AFTER me murdered this poor woman. He robbed the place months before this happened. He should have been in jail!

I agree, the company should be sued for not responding to the other woman's complaint about being SEXUALLY ASSAULTED on their property!!!! Donna may still be alive today. Sick man, and I do hope the kids get the money. She was a single mom trying her hardest to take care of her children. The kids would have a better shot at life.

I certainly understand the tactical decision to explore the company's potential liability given that derelicts like Dwyer have no money to pay restitution but establishing that to the employer it was reasonably forseeable that he would commit the heinous crimes involved here is going to be extremely difficult even assuming all of the above facts are true.

While I don't think companies should automatically deny employment to someone only for being a felon.... there were complaints that included assault on another employee! That woman should have pressed charges against him and not settled for this companies laziness. He should have been fired and charges pressed...... I can't imagine any reason why this woman and the company didn't pursue this further.
The parole (note spelling concerned KD..... just saying.....) board should never have let him back out after violating parole with another violent crime. That said.... since the other work incident was not reported to the police the parole officer didn't know about it. The parole officer would have been notified had it been reported.
Just goes to show what happens when things get swept under the rug.... this other woman must feel horrible now.
This company is (at least) partly responsible for allowing this man to use their premises for his personal hunting ground.

Okay, number one, ACS doesn't hire mostly women, men and women work side by side, about a 50/50 ratio. Number 2, ACS will hire anybody!!!!! The place is the biggest dump in town. I can't believe they ignored this womans complaints. Check out ACS, I swear to God they will hire ANYBODY. That place...

Well...... however tragic and senseless this whole case is the employer should not be sued for hiring this man..... It should be for not removing him from the workplace after harrassment occurred. Not hiring him because he was a felon is discrimination.. Then he would be sueing them.... Everyone sounds eager to blame the company for this womans senseless murder, however where is the responsability of the perole board who placed him in the community.... If there is anyone that bears the burden of responsability for his being in a position to reoffend/ assault women it is on the perole boards shoulders... where is they're accountability. Should the family be able to go after them or the victims funds that is reserved by Law enforcement for financial restitution to victims of crimes.. What is the real/legal answer here. They might be digging a dry hole.. I dont think there is any water in that well.

Queenhoneybee---No it will not bring her back---but there are 2 children that would have been raised and supported by their mother being alive (there is your motive) supporting the children that were left behind. They no longer have that option. It sounds to me like ACS put their employees at risk by --1. Hiring him in the first place --2. Not warning their employees of the danger 3.--Not following up on prior complaints against him. There is a reason why the application asks if you are a felon---so prospective employers can find out if you are a "fit" for the company. Obviously, given this mans history, he was not a "fit" for the company. He should have been working at a transfer station (dump), being the piece of trash that he is.

I'm sorry for the loss of the family. I'm can see both sides although for myself-to blame a company on it is just maybe not the right thing. At this point its a question of motive. Its not going to bring her back and its not going to make life any easier. On the other hand-when ACS was LiveBridge, the employers did extensive applications and interviews. If someone was a felon, they would not hire you. They didn't even want to hire if you had a misdemeanor. At one point, I needed my schedule and seating to be changed because I was getting harassed at work. I kept making requests and talking to H.R. and the such... they just wouldn't change my seating. So I left. Separately, all too often sexual harassment still goes on in the work place in Maine-and these woman and sometimes men feel like they can't go to anyone because they will lose their job no matter what it states in Maine (Un)Employment Laws. The companies don't seem to care either-they will fire someone, and who has the money to try and fight them? I know a place now that will not hire any females at their store so they don't have to deal with it.

Maybe I can clarify, I am not a complainer (when it came to being attacked or violated), I'm not a money-seeker, I do not place blame on any difficult event that has happened in my life... I'm a forgiver, and even in death (god forbid if something as awful as this or worse happens) I wouldn't even wish a death penalty (if it was legal in Maine) and I would want my family and friends and those around me or estate to do the same out of respect for me.

It is illegal for any company not to hire anyone because of their gender. I hope that the company you are talking about gets in big trouble for this and I hope you report them. I know your for EQUAL RIGHTS so here is YOUR chance to prove it. It is your responsibility to report them. That's the same thing as saying I won't hire some one because they are homosexual, black, french, german, russian, catholic, muslim etc.. it's WRONG! If any person is qualified for the job, they should be hired.

An employer is capable of doing a background check, and in most cases, a job application asks if you are a convicted felon, and where you have been for the past few years of your life. People working at large businesses cannot possibly obtain background information on every co-worker. It is the responsibility of the employer to keep their employees safe (note** workers comp), and it shouldnt stop with workplace injury. While I understand that people released from prison need to work so we are not supporting them forever, there should be guidelines on where they can work. Someone convicted of a crime committed against a child, cannot be around children. If this man had been in previous trouble with violence toward women, he shouldnt have been working at a company that employees mostly women. If they knew he was a danger to women, he never should have been employed there, or it should have been mandatory that ALL employees knew his history, so they can be aware of the dangers and not meet with him for any reason, or be alone with him.

Given this guys history I believe the company should share responsibility along with the Lewiston PD. They knew he was a threat to society and I am pretty sure they knew where he was working. He was under investigation for the armed robbery at the Big Apple on Lisbon st. They had evidence it was him (had DNA evidence) and never locked him up. They charged him for that robbery AFTER he was detained for questioning in the murder of this woman.

While I feel sad that this life was ended by a dirtbag to sue the company is just wrong !!!In no way did they cause the death of this young lady! The resposibility lies with the individual that committed the crime ! His life should not be spared !!!
