Abused wife pleads guilty in husband's shooting

ROCKLAND, Maine (AP) - A 31-year-old woman faces no more than a year behind bars after pleading guilty to domestic violence manslaughter for fatally shooting her sleeping husband in their home last December.

Amber Cummings will be sentenced in January after pleading guilty Friday in Knox County Superior Court to shooting 29-year-old James Cummings twice in the head while their 9-year-old daughter was at home. She told police she was abused mentally, physically and sexually by her husband.

A plea agreement calls for a sentence of up to eight years with Cummings to serve no more than a year in jail, followed by six years of probation, said Deputy Attorney General William Stokes.

Stokes said the plea agreement reflects an understanding of the violence Amber Cummings endured in the marriage.

"This is a recognition that we had an extraordinarily abusive and dysfunctional relationship which justifies our willingness to accept the lesser charge of manslaughter," Stokes said.

Cummings' attorney, Eric Morse, told the Bangor Daily News that he will argue that Cummings not be required to serve any jail time when she is sentenced. She is now free on $50,000 bail.

"From the very beginning she had explained to police that she had been abused and was basically defending herself and her daughter," Morse said.

Cummings told police that her husband was a white supremacist and was plotting to build so-called dirty bombs and set them off during President Barack Obama's inauguration. Radioactive materials were removed from their home after his death, but authorities said there weren't enough to make a dirty bomb and that the public was never at risk.

Police also discovered a large amount of child pornography on computers taken from the home.

there are lots of these scum bags out there that should be taken out as well, and my father was one! if only my mother would have done the same! she had 6 kids to protect from that monster and herself. its a wonder we all survived and turned out normal.

So much for him being able

So much for him being able to defend himself! I'm not saying he's not guilty of any abuse, but there is nearly always two sides to every story (she may have been just as guilty as him regarding abuse), but only one side was heard. She was able not only to tell her side, but to add or exxagerate in any way she pleased with no one to refute it.
I wonder how it is that she can claim "defense" over shooting him when he was asleep at the time....
