Lewiston schools chief sues Fox News

Lewiston's school superintendent has sued Fox News and two hosts of the network's morning show for libel and slander, stemming from comments made on the show about a racial incident at Lewiston Middle School.
Leon Levesque filed suit on June 22 against Fox News Network LLC and two hosts of "Fox and Friends," Steve Doocy, of Wyckoff, N.J., and Brian Kilmeade, of Massapequa, N.Y.
Filed in U.S. District Court in Portland, the suit alleges Fox, Doocy and Kilmeade defamed Levesque during an April 24 episode of "Fox and Friends," in which items from a parody about the ham incident were reported as fact.
"[Levesque] has received a significant amount of electronic hate mail and harassing telephone calls as a result of the broadcast of the false and defamatory statements," Levesque's suit states. The superintendent is represented by Bangor attorney Bernard Kubetz of the firm Eaton Peabody.
Levesque also alleges Fox, Doocy and Kilmeade knew the facts they broadcast about the incident were false, and that their comments damaged Levesque's reputation in his community and profession.
On April 11, at Lewiston Middle School, a student put a bag containing a ham steak on a table where Somali students were seated. Officials interpreted it as a hate incident meant to offend the Muslim students, whose religion eschews pork.
An investigation resulted in one student being suspended for 10 days, but no formal charges were filed.
On April 23, an online parody of the incident appeared, containing fabricated quotes attributed to Levesque. "Fox and Friends," along with other news outlets, picked up the satirical version and rebroadcast its contents as fact.
"The superintendent, who looks as though he's going to the hilt with this, says it's akin to making these kids feel like they're being shot at back in Mogadishu and being starved to death," said Kilmeade, according to the suit.
Doocy, the suit states, declared "Fox and Friends" was "not making this [story] up," and that he had personally "looked [the story] up on a couple of different Web sites up there, from local papers."
Levesque seeks damages greater than $75,000, according to the suit. |

I can see this leading to a press conference on Nomar Court with you claiming your All-American reputation in this All-American city has been tarnished beyond repair (or a $75,000 payoff). I hope Fox comes here with cameras and blasts some of the fools running this town as payback.

I would never sue someone over that. news is news and that is what the news is for is to let us know what is going on sad to know they let that get to them. Lewiston superintendent of the schools over in lewsiton should let it alone and get over it. the news was against him/her. if it was then maybe but its not. it had to do with a ham being set infront of a muslim. It is the parents of that child that would have the right to sue but they havent so the schools superintendent shouldnt either. The kids didnt make the muslim eat the ham or rub it all over him/her. Alls they did was set it infront of the kid. That isnt discrimination or racial.

Fox's actions were extremely unprofessional and I see nothing wrong with Lesveque trying to bring sanctions against them. I would be very surprised if this was about the money. Now Shenna, can you explain why the parents of the kids in this case would have any grounds to sue Fox, when Fox did not misrepresent their words?

At any rate, schools never have much money anyway, so why not take these morons for all they can get?

Mr. Levesque has every right to sue. I hope he wins.
The exchange (between 4 people, not 2 - the segement happened during a "hand-off" from one show to another) was completely inappropriate.
Those 2 men in particular made comments against Mr Levesque personally. While the superintendent was peripherally aware of the incident, he was not involved in the disciplinary decision. The administration of the middle school handled the entire matter.
Mr. Levesque has reason to sue. I hope he wins.

I hope FOX news wins any law suit.

Posted By:gl at July 1, 2007 1:19 AM (Suggest Removal) Superintendent Levesque has every right to file suit over this matter, he has done nothing wrong he was acting as the superintendent and made the correct decisions during this episode. The blame here lies with the news media who are so quick to report news of any kind and many times not even checking for the accuracy of the story, the news media should and needs to be held responsible for it's action especially when reporting inacurate news, a persons reputation once tarnished can never be fully repaired. Mr. Levesque reputation in the state is by far the best in his field, and is recognized as one of the top superintendent in tha State of Maine if not all of New England. The news media can find themselves lucky that the suit is only 75,000 should be for at least 10 times that much. Unfortunatly after reading the previous comments find that a number of persons responding to this news are not very well informed and have an axe to grind, take it from someone who knows from experience. To all who disagree with the route that the Superintendent is taking, to them my final comment, this is why Mr. Levesque is Superintendent and why you are where you are, it's very difficult to understand one person wanting to protect his reputation when you don't have one to protect.
