Former teacher pleads guilty

A former Monmouth Academy teacher has admitted to having a sexual relationship with a 16-year-old student.
Christopher Dumaine, 39, of Readfield, pleaded guilty in Kennebec County Superior Court on Tuesday to two counts of gross sexual assault, two counts of unlawful sexual contact and one count of violating conditions of release.
He was sentenced to four years in jail, with all but nine months suspended. He was also sentenced to three years' probation, with the stipulation that he stay away from Monmouth Academy, the victim and anyone under 18, except for his children.
Dumaine must also register as a sex offender for the next 10 years.
In a statement, Kennebec District Attorney Evert Fowle said Dumaine "violated a sacred oath and duty as a teacher" when he had sex with the girl.
The 16-year-old, however, felt differently. In a letter to the court, she professed her love for Dumaine.
"(B)e it perceived morally disgraceful or a young ideal, it is what it is, and no one can convince me otherwise," she wrote.
Dumaine, a longtime English teacher at Monmouth Academy, had been the girl's teacher at various times. Their relationship began in June.
On Sept. 14, three high school teachers reported seeing the girl at Dumaine's home and raised other concerns with the school's principal, Fowle said. After the principal told the girl's mother of their concerns, the girl confessed to her parents - and to police - that she'd been having a relationship with Dumaine.
On Sept. 17, Dumaine abruptly resigned from Monmouth Academy.
Days later, with consent from the girl's parents, police searched her car and found a blouse with stains on it, which they took as physical evidence, Fowle said. Dumaine was indicted in October. He pleaded not guilty and was released on $5,000 bail. As part of that bail, he was prohibited from having any contact with the girl.
But soon after, police spotted Dumaine and the girl together at his home. He was returned to jail.
Although the girl has professed her love for Dumaine and denies being a victim, her parents backed the charges against him.
"They were fully supportive of our efforts to prosecute him," Fowle said.
In her letter to the court on Tuesday, the girl railed against Dumaine's future bail conditions, which will prohibit him from having contact with her after his release.
"I don't see how this restriction is better for me; for it is limiting my pursuit of happiness where I see it should be granted," she wrote.
Fowle, however, said the jail time and probation were justified.
"Overall, we're satisfied with the result here," he said. |

What we need to do is teach our children what is, and what IS NOT appropriate behaviour (for teachers AND themselves) and to have a little self respect. Women are just as capable of manipulating and hurting children- Mary Kay Latourneau anyone??!! There is not doubt that this guy is a major perv--but let's not condemn all men.

The hormones that run their systems override any common sense. As for men, the hormones override any common sense. Too bad they are willing to sacrifice their families, home and careers for that, but they do it every day. Sometimes they get caught.

Posted By:David at November 14, 2007 10:13 AM (Suggest Removal) James, simply put: you're wrong. There is no law that states consensual sexual contact with anyone 16 or older (other than with a teacher/psychiatrist/psychologist/social worker/parole officer) is illegal.
The crime to which I believe you are referring to is:
§255-A. Unlawful sexual contact
1. A person is guilty of unlawful sexual contact if the actor intentionally subjects another person to any sexual contact and:
S. The other person, not the actor's spouse, is in fact less than 18 years of age and is a student enrolled in a private or public elementary, secondary or special education school, facility or institution and the actor, who is at least 21 years of age, is a teacher, employee or other official in the school district, school union, educational unit, school, facility or institution in which the student is enrolled. Violation of this paragraph is a Class E crime; [2005, c. 450, §1 (amd).]
The 21 year age restriction in this case is to impose a different sentencing standard for school employees 21 and younger (class E crime), whereas the same crime committed by someone older than 21 (see sub paragraph K) is a class D crime (more serious).

Posted By:??? at November 14, 2007 10:42 AM (Suggest Removal) Then why David was I told that when my 16 yr 3 month old took off with a 19 year 3 month old ( across many state lines) that there was nothing the law could do and that the age of sexual consent was 14 in the state of maine as long as the other party was not 5 years older. I know that there is a bigger age diferrence here, but I am curious and I was told this by an attorney in Waterville.

Posted By:David at November 14, 2007 10:53 AM (Suggest Removal) Curious, I'm not an attorney and I won't give you legal advice on your case, I was simply explaining to James that it IS legal for a 16 year old and a 39 year old to have consensual sex provided the 39 year old isn't a family member, licensed social worker, teacher or other explicitly forbidden class of individual.
That said, I'm sorry to hear about your child...

Yes he broke the law, but it comes back down to the parents, and they are doing the right thing. At 16, kids start to do their own thing, you can only hope and pray and JUST KEEP TALKING to your kids.

They shouldn't be teachers, doctors, nurses, lawyers, clergy, firemen, policemen, judges, construction workers, taxi drivers, store clerks, movie theatre ushers, or performers. Hey wait a minute-they shouldn't be parents!!!!!

Posted By:Holden at November 14, 2007 6:17 PM (Suggest Removal) There was a similiar case in the MidCoast area this past few months too,..the guy was a former teacher 40/41 and the student was 17,..he never faced sexual charges because of the law intrepreted like the above post. Granted, he did get in trouble for other things, but the parents over-reacted, the girl lied to police, and he's toast.
