Porter man pleads not guilty in fatal crash

PARIS - A 22-year-old man pleaded not guilty Thursday in Oxford County Superior Court to charges related to a fatal car accident last summer.
Mark E. Tardiff, Jr., of Eastman Hill Road in Porter, was arraigned on charges of manslaughter, aggravated operating under the influence, operating under the influence, and providing alcohol to minors.
According to Sgt. Timothy Ontengco of the Oxford County Sheriff's Office, Tardiff was the driver of a 1997 Plymouth Neon that crashed on Route 25 in Porter at 1:30 a.m. on July 4.
Bianka Cousins, 17, of Parsonfield, was killed after the car skidded into a utility pole and rolled over onto its roof.
Devin Spencer and Erin Hartford, both 16, suffered minor injuries in the crash, as did Tardiff. They were taken to Maine Medical Center in Portland for treatment.
Ontengco said Tardiff was bringing the juveniles home after a pit party where alcohol was consumed. He said Tardiff and Cousins had dated at one point and Spencer and Hartford were mutual friends.
"At some point, there was some disagreement between the occupants," said Ontengco.
According to interviews with Spencer and Hartford, Tardiff began driving at excessive speeds after the verbal argument and was unable to negotiate a curve, he said.
The Oxford County Sheriff's Office was supported by the Cumberland County Sheriff's Office and Maine State Police in the crash investigation.
"The reconstruction indicated that the driver's actions contributed to the crash," said Ontengco.
Tardiff was arrested on July 9 on a probation violation. Ontengco said Tardiff was on probation for an assault charge and was not to use or possess alcohol.
Tardiff is currently serving a 300-day prison sentence. Defense attorney John Jenness Jr. said the sentence began in December and Tardiff could be released as early as April.
Justice Roland A. Cole set Tardiff's bail $5,000 cash or $10,000 surety. Tardiff is also prohibited from using or possessing alcohol and operating a motor vehicle without a license. |

Posted By:mallory at February 8, 2008 9:04 AM (Suggest Removal) I don't agree with jail forever, but do think there should be stiffer sentences when a death is involved, and that he is kind of old to be hanging out with teenagers.
And I'm sure more people drive drunk than will admit to it, they have just been lucky.

First of all, I am not a LIBERAL! Although I do live in a liberal state!
I take it your opinions are right and those that disagree with you are wrong?! or LIBERAL!
I do think this young guy should be punished...I did NOT ever say he should walk..I just thought FOREVER was a bit harsh. I would imagine if he has a conscience he's living in his own hell.
I would be absolutely devasted if a drunk driver killed anyone in my family and/or anyone else's family for that matter. I am not making excuses!

Unfortunately I did drive under the influence in my late teens, early twenties while in college and I am lucky I never hurt anyone. Is this death any worse than the boy who was killed in the Karkos car accident? They were racing at high speeds through the city and he lost control, killing a young man. Didn't even get as much as a speeding ticket. I hope Karkos does something really important with his life to redeem himself and I hope the same for Tardiff. Life it too harsh but 4 years of community service to high schoolers and college kids about the dangers of drunk driving would benefit the community more than locking him up!

I never had an accident my entire driving years. But I admit I have drove drunk and I am very fortunate and I now know it. I went to a driving school. I didn't drive too young as I see often today. Also it was during a time when if you were stopped by the police they usually just said "drive straight home and don't stop anywhere else"
Hard to imagine that happening today unless the cop is a friend.
