Social Security fraud results in federal prison sentence

A Lewiston man has been sentenced to nearly two years in federal prison for collecting Social Security benefits for children he was no longer caring for.
David M. Mailly, 42, was sentenced in U.S. District Court to 21 months in prison to be followed by three years of supervised release.
He was also ordered to pay $2,100 in fines and $41,186 in restitution to the Social Security Administration. Mailly pleaded guilty to a fraud charge on Nov. 8.
According to court records, Mailly applied for benefits in June 1998 and was awarded Social Security disability funds for himself and his two children. Mailly was designated as the representative payee for the payments made to his children, which were directly deposited into his bank account.
In July 1999, however, the children were removed from Mailly's care, according to the U.S. Attorney's Office. Mailly did not disclose that information to the Social Security Administration. As a result, between July 1999 and August 2006, he received Social Security payments totaling $41,186 intended for the benefit of his children, which he did not use for their benefit.
Mailly's sentence will be served in a federal prison. |

It is people like him, that take advantage of benefits offered, that make families like mine lose out. Who knows who else is doing the same. And years down the road when more families qualify for benefits they wont get them because selfish people like this man used up all the funds for himself when he could have provided for his children like a real man would do. What kind of parent takes away from their children???

Posted By:anon at February 29, 2008 8:22 AM (Suggest Removal) The father is a criminal and should be punished but there is another criminal in this case as well...This went on as long as it did because DHHS did not do its job on behalf of those children. once again, poor case management skills...have you ever met a children's case manager? the one's who are educated and have a good head on their shoulders are few and far between...the university system should be screening potential students in their social work programs and not accept the ones who appear to have the potential for being unable to remain objective or lack the social and intellectual skills or moral fiber needed to do the job. our children should be important enough that we want social workers involved in their care to be qualified and capable of doing the job well. this kind of lack of oversight from case workers is what allows children in foster care to suffer abuse and die in the state's care.

Posted By:albert at February 29, 2008 9:16 AM (Suggest Removal) how many of you know that if you are on disibility, and can work, you can collect your full check for 9 mos, regardless of income made. if you continue to work after 9 mos, your case will be kept open for 5 yrs. if during that 9 mos time you are out of work, when you return to work, your 9 mos period will start all over. i know of someone who over the last 3 yrs has grossed an income of $50,000.00 yrly and still collected disibility.
this is your goverment at work.
what makes me mad is that people who have paid ss while working for years and retired get penalized if they make over a certain amount.
shame on our goverment

If only more of the public were aware of the VERY capable people in Lewiston collecting benefits that SHOULD be working, they would be amazed. Do you really think this guy is going to pay the $40,000 dollars back? No way. He was collecting from the Govt to begin with. Guaranteed if he does, it will be with more govt money over his LIFETIME, if at all.
People pay into the SSI system, only to watch their hard earned dollars end up in the pockets of dead beats who drink and drug OUR money away.
Please keep looking for these thieves by putting MORE investigators in place to catch them. Get our money back to the PEOPLE.

I'v worked hard all my life and put into the system for over 40 years. It makes me mad when I read about these deadbeats who know how to beat the system. That money should go to the people who put in,not the ones who are too lazy to work.

don't get me wrong.. there are some out there that truly do need disability, and they get a bad wrap for those who cheat the system

Posted By:Lincoln at February 29, 2008 2:23 PM (Suggest Removal) If only the state policed its own programs and considered it fraud when they stop requalifying people and instead expected them to actually verify income and dependents annually before giving them everything, wow what a lesson that would be. Some programs could be expanded due to the monety now given to people who no longer qualify but have not been asked to reaffirm their needs, so it just keeps coming to them.
