Judge in stabbing case: 'It's only a great deal if he stays out of trouble'

PARIS - A 39-year-old man charged with entering his ex-girlfriend's home last spring and stabbing her new boyfriend in the neck will not face any additional jail time, a judge ruled Thursday.
Dwight Knox, of 11 Church St., Jay, pleaded no contest to felony aggravated assault in Oxford County Superior Court. Justice Roland Cole sentenced him to serve 14 days of a three-year sentence, along with two years of probation. Knox will not return to jail because of time served following his arrest.
The sentence came as a result of a plea agreement between Assistant District Attorney Joe O'Connor and defense attorney William Maselli.
"Obviously, on the face of it, this is an incredibly light sentence," said Cole. "But it's only a great deal if he stays out of trouble."
Knox was indicted in June for attempted murder, elevated aggravated assault, aggravated assault, burglary, violation of a protection order, and violation of conditions of release. He was accused of stabbing Tony Leonard, then 37, in the neck on May 14 while Leonard was sleeping at a Rumford residence.
Knox was later arrested at his home, then in Rumford, and released on surety bail on June 1.
O'Connor said Knox had "expressed his dislike for black people and expressed his desire to kill black people, especially Mr. Leonard."
According to O'Connor, Leonard was able to recognize Knox because Knox's ex-girlfriend had pointed him out to Leonard in a Wal-Mart and because there were photos of Knox in the apartment. Both Leonard and the woman stated that they recognized Knox as he left the residence after the stabbing.
However, O'Connor said a jury could have found Knox not guilty by reasonable doubt. He said the woman recanted her statement and subsequently recanted the recantation. Moreover, when presented with an eight-man lineup, Leonard initially chose a person with a resemblance to Knox and not Knox himself.
Cole noted that Leonard has a criminal history, and could have been impeached as a witness.
"That case had many challenges from the beginning," said Detective Sgt. Daniel Garbarini of the Rumford Police Department, who investigated the incident. "I think because of the challenges that existed in that case, the District Attorney's Office did well." "You're disappointed to see that little," he added, "but in the same token, I'm glad to see there was a conviction out of that."
O'Connor said Knox did not have any serious bail violations related to the charges aside from contacting the woman, with whom he has a son. The conditions of Knox's probation set on Thursday require him to have no contact with Leonard.
According to the aggravated assault indictment, the charge was raised from a Class B offense to a Class A offense because Knox was convicted of assault in Oxford County in 2000 and 2001. Knox's criminal history in Maine and Florida includes convictions for criminal threatening, theft, assaulting law enforcement officers, indecent exposure, burglary, and shoplifting.
He was charged in 1990 with homicide and attempted homicide in Florida, but was not convicted.
"I'd like to think Mr. Knox can take this as a learning curve and make the corrections that he needs to learn a different lifestyle," Garbarini said. |

It is obvious he has severe pschological issues that are not being dealt with. Hope I'm not around when he goes off the deep end... again. I hope that Joe O'Connor isn't either.

I remember him as always being in trouble from elementary school to getting arrested in junior high....time will tell when he does something else, and he will do something else!!

We need to get rid of bleeding heart judges who seem to be putting people at risk! Maybe they need to see how light their sentences are and if the perp doesn't straighten out, then the judge is let go.

And they still allow him to walk free? And people get angry at others that have recently taken the law into their own hands? It sure doesn't seem our judges are protecting us like they should be!

This is just another in a frightening pattern of Maine district attorneys and judges letting criminals go free with light or no jail time. Knox is a ticking time bomb, but these liberal DAs and judges can't see past the ends of their noses. The list is endless of criminals who get numerous "chances" to become productive members of society: Pedophiles, rapists, drunk drivers, people who murder or attempt to murder, robbers, burglars, etc. Somebody should do some research and put together a website devoted to exposing criminals who have gotten away with heinous crimes here in Maine. It would be a VERY long list.

No, I will not move for other states are as lenient, but it's pretty bad when you have to watch your back while you are anywhere outside your home,at any time, because of the mentally ill people that are on the streets - everywhere in this state. Riverview will never have enough space to house them - or rehabilitate them. CLOSING AMHI was the worst thing the state could have done!

It isnt fair to assume that this incident was because of me, because it WASNT! It was caused because ONE man can not accept the fact that ALL menare equal, and he cant get past his issues of anger and agression. Tony (Leonard) was the unfortunate victim of a very deranged man named Dwight Knox. Unfortunatly for myself and the children Knox and I share, people like the one who posted a comment with my name in it, are always going to judge us BECAUSE of HIM! Carma has a way of convicting us even when we feel we have been let go and discharged of wrong doing, so with that said, I am CERTAIN Dwight will receive all which he deserves. Unfortunatly he has moved onto a new "victim" with children. I can not get back the time Knox took from my children and I, 8 months in foster care because of his actions, and I finally get them back. Guess he is the only person out of all of this who has won!

They routinely allow plea bargains behind the scenes without telling victims and it would not surprise me to find out that knox threw one of his friends or cohorts under a bus to get this sweetheart deal. Happened to my family so I'm not just trash talking.My sympathy to the victim, and if you know knox and just got arrested, you know where the information most likely came from.

There are several victims involved in this crime, Tony Leonard stabbed while he slept, but also the children who were ripped from there home away from all they know, because there father or once father figure is racist, and decidied one night to play god. There is always a "what if" in every situation. My what if is what would have happened if Mr. Knox would have suceeded in filling his plan to Kill Tony, he would have left my daughter fatherless.Karma, I believe in, one day Dwight Knox will get what he truly deserves, it can come in any shape or form, but his judgment day will place him where he belongs!

Posted By:James at March 21, 2008 7:18 PM (Suggest Removal) Dear MARTHA: It's obvious your view of the Dechaine case has not considered the evidence (from the secret files of Maine's attorney general) which were made public by our Legislature and the courts -- proof of lies by detectives and the prosecutor; evidence concealed by the state; DNA proving that Dechaine isn't the killer; more evidence incinerated by the state right after Dechaine filed an appeal. It's OK if you don't care about these official documents. You're entitled to your opinion. But it's unwise to advertise your indifference to evidence online. It makes you look careless. The link I gave (above) includes copies of the official documents that prove what I say.

This is a guy that spend a number of years in a Florida state prison for attempted murder of a police officer. NICE!! He attempts to murder another guy and they let him walk out. We can all say what we would have done in this situation, but until we are in it, we don't really know. I think Shelley and her kids have suffered enough. And imagine how the kids feel having a dad like him? Let's give her a break.
