Roberts asks high court for new trial

PORTLAND - Nearly a year after Daniel Roberts was sentenced to prison for shooting his ex-girlfriend, the Sabattus man will try to get a new trial.

Roberts and his lawyer are expected to be in the Maine Supreme Judicial Court Thursday afternoon in an attempt to have the murder conviction overturned.

Roberts was sentenced last June to 55 years in prison for the 2005 killing of Melissa Mendoza, 29. He was convicted of the charge in February 2007.

On Aug. 15, 2005, Roberts shot Mendoza in the back of the head at his home in Sabattus. He never denied shooting his ex-girlfriend, the mother of their then 2-year-old daughter, but said he did so because he believed Mendoza was going to harm their daughter.

The jury did not accept the argument and found Roberts guilty of murder.

The appeal mostly argues that errors were made in the instructions given by the judge presiding over the case to the jury at the end of prosecution and defense arguments.

The appeal contends that:

• the court abused its discretion in admitting photographs of Mendoza and her daughter over the defendant's objections;

• the court abused its discretion in excluding the testimony of two women who would have supported the claim that Mendoza had threatened to kill Roberts;

• the admission of Mendoza's protection-from-abuse affidavit violated Roberts' constitutional rights;

• the court abused its discretion in admitting evidence of past incidents of vandalism to vehicles owned by Mendoza and another woman;

• the court erred in instructions to the jury on justification;

• the court erred in instructions to the jury on the elements of criminal restraint by a parent;

• the court erred in instructions to the jury on ignorance of law or fact;

• the court erred in instructing the jury that the state needed to prove that Roberts did not believe Mendoza was about to use deadly force and commit kidnapping when she was shot;

• the court erred in instructing the jury on the provocation element of justification;

• the prosecution's closing argument constituted prosecutorial misconduct.

Roberts' lawyer, Tom Marjerison, will argue the appeal at 1 p.m.

Roberts shot her in the back that tells it all. He could of stopped her another way but a dead person doesn't lie. I wouldn't want him out in the streets, he's a walking time bomb.

This guy is nuts. Taking his points one by one, he has no argumentfor a new trial 1) showing pictures of victim is commonly used to gain sympathy for the prosecution. His objection is that it worked the way it was intended. 2) By not allowing two women to testify to what they "heard" is appropriate as it is hearsay and not admissible since Ms. Mendoza isn't there to acknowledge or deny it. 3). POA is a public document and shows previous history of violence it is a valid piece of evidence. 4) his history of vandalism related to women he was involved with is completely important to show his violent history. He is blowing smoke about those issues anyway. If he didn't want to have those things brought up then he shouldn't have done them to start with. He is an abusive man who killed the mother of his child. He deserves to stay in jail.

If he truly thought that the mother was going to harm their daughter there were other things that he could have done besides killing her. Basically their appeal states that they want the truth thrown out. He is right where he deserves.

Did ANY of you know Dan? Or are you basing your knowledge of him on what was reported in the news? That's what I thought! These are part of the reasons he's looking to get a new trial. He never denied shooting her. But the fact that someone is mortally threatening your child will make one go into survival mode. So he deserves to be heard with out prejudice! Savannah misses her Daddy! We are praying for you Dan!!!

A to Z, yes I know Daniel Roberts very well. He is a violent criminal, and is where he belongs. Savannah is too young to know what she's NOT missing.

It's amazing how most of you bloggers are now all judge and jury. UNTIL you walk a mile in another mans shoes, you have no clue. You only know what the news puts out. Until you know this man on a personnal level, as part of your family, then you don't know him. This situation has hurt all, Melissa's family, as well as the Roberts family. Melissa is gone. But Dan is gone too, as well as Savanna. EVERYBODY is missed in one way or another. I hope none of you ever have to face what either one of these familys have indured. It's pure hell, and ones worst nightmare to ever have to think about or go through!!!!!!!

DAN HAS THE RIGHT TO APPELA, MAY OR MAY NOT GET HIM ANYWHERE, BUT THAT IS HIS RIGHT. I HAVE KNOWN DAN FOR MANY YEARS AS WELL AS HIS FAMILY AND THEY ARE ALL SUFFERING. I THINK THE OTHER THING THAT IS WRONG IS THAT SAVANNA ENDED UP WITH MELISSA'S FAMILY, WELL WHAT ABOUT HER GRANDPARENTS ON DAN'S SIDE. THEY HAVE LOST THEIR GRANDCHILD AND SHOULD HAVE EVERY RIGHT TO SEE HER AS WELL, SO YES THAT LITTLE GIRL IS SUFFERING. THE ONLY THING SHE IS HEARING RIGHT NOW IS WHAT MELISSA'S FAMILY WANTS HER TO HEAR AND THAT IS NOT RIGHT. I FEEL SHE SHOULD BE ABLE TO HEAR THIS SIDE AS WELL. AGAIN ALL THE FAMILY MEMBERS ARE SUFFERING ON BOTH SIDES AS WELL AS THE EXTENDED FAMILY. DAN GO AFTER WHAT YOU THINK IS RIGHT. THOUGHTS ARE WITH YOU.
