Sumner man enters no plea to murder charges

PARIS - A crowd of onlookers was kept behind a police line in the Oxford County Superior Court parking lot as Duane Waterman, charged with killing two men in West Paris, was led into the courthouse Tuesday.

One onlooker shouted at Waterman, calling him a "murderer" and a "menace to society."

Waterman, 31, of Sumner did not enter a plea on Tuesday. A grand jury will decide later this month whether to officially charge him.

He was arrested Monday and charged with murder in connection with the shooting deaths of Timothy Mayberry, 50, of West Paris and Todd Smith, 43, of Paris. Both men were found dead of multiple gunshot wounds on July 26 at Mayberry's residence on Tuelltown Road.

Relatives of the victims were in court Tuesday to see the man charged in the killings.

Katie Tripp of Oxford, whose husband is Smith's cousin, described Smith as "happy-go-lucky" and "outgoing ."

"I think everyone's just angry and wants to know why this is happening," she said.

An arrest report provided by the Oxford County Jail states that the shootings occurred between 9:30 and 10:45 p.m. on June 25. Mayberry's body was spotted by a motorist near a stone wall outside his house; Smith's body was found inside. Police searched Waterman's house for three days last week. He was arrested without incident Monday afternoon while fishing with his children on Brettuns Pond beside Route 4 in Livermore.

Superior Court Justice Roland Cole ordered Waterman held without bail until Sept. 3, when a bail hearing will be held. Cole said a bail hearing may be held earlier if one is requested.

He also ordered a 35-page police affidavit, which likely includes details of the search of Waterman's house and what police found there, to be impounded until after the bail hearing.

Lt. Brian McDonough of the Maine State Police said the investigation was ongoing and that evidence was being analyzed at the state crime lab. "There's a lot in the investigation and it's very early into it," he said.

Todd and Mayberry died on the 25th.The biggest thing that is making me so angry is the mug shots of the two in the paper and on tv. there are alot of people mad about that..those two were VICTIMS!! I personally know the Smith family, And it has been devastating for them to see all the crap the papers and tv have done..its just terrible!!

D, addiction is a disease and bad things happen to good people and bad. There are alot of good people that suffer from drug addiction and alchohol addiction in Oxford County and the surrounding counites. Drugs don't make good people bad. Bad people that use drugs do bad things. Either your one of the special people God appointed to represent him in judging people or your fortunate enough to have perfect people in your life. Either way, your wrong in judging these people by catagorizing them with your "druges" and in a sense saying that "murder" happens when you use drugs. BS

Yet another person guilty in the court of public opinion. You are all so quick to jump to the defense of the victims being portrayed in a negative manner, yet you have no problem convicting the man that hasn't officially been charged with the murders. Way to go. Chalk another victory up for the self-righteous. Maybe the guy is in fact responsible, but none of of know this yet. So for the sake of contradicting your shallow "values", just cease your meaningless discourse and wait for the charges to be official and the hearing to conclude.

In reply to ingognito: FYI, the immediate family did contact the media. There was a message left asking them if they needed any correct info or pictures of my brother to please contact us. There was no response to our request! My brother may not have always made the best choices in his life, nor do any of us. The person that was portrayed as a criminal in the media was a victim, not a perpetrator. If you knew my brother you would know him as a sensitive human being, a poet and a songwriter that could bring tears to your eyes and a smile to your face in a matter of minutes. It was apparent by the amount of friends and family that have reached out to us in this vey tragic time. To all of you who really knew Todd, THANK YOU !! TODD, You will always be our missing link, but you will always be in our hearts. To bad we did not have one more road trip!! Your loving oldest sister, Karen

D, since we're into stereotyping here...I'm pretty sure that you did not graduate from high school and you're probably on welfare. Correct? By the way, somebody "no's" what happened that night and hopefully he's in jail. If not, then his or her time will come.

While no one deserves to die, these were ot "innocent" victims. These idiots sold baking soda as cocaine, thereby making them drug dealers- no innocent victim. They perpetrated a crime and paid the ultimate sacrifice for doing illegal dealings. Drugs were the main reason why I left Maine, that and the fact that all the selling and dealing take place less than a mile from the police department at the Yellow Submarine.
