Former teacher says he's innocent

AUBURN - James Raymond Jr. told a jury Wednesday that he was lying when he told police he molested students at the elementary school where he taught music.

He hoped his fabrication would cut short the 2˝-hour interview with a local police detective, Raymond said after taking the witness stand.

He testified for more than an hour the second day of his trial at Androscoggin County Superior Court. The 27-year-old, a former teacher at Park Avenue Elementary School, is charged with two counts of unlawful sexual touching and three counts of assault involving three former students.

A jury of four women and eight men began deliberating Wednesday after lunch, but hadn't reached verdicts on the five counts before they were sent home by the judge at 4 p.m.

They asked to listen to the testimony of one of the alleged victims, who said in court Tuesday that Raymond had touched her buttocks last fall at the end of class as she was exiting a portable classroom. Jurors also asked to review a videotaped interview with that girl when she described the alleged encounter. The jury is expected to be back in court Thursday morning.

The state rested its case Tuesday after one day of testimony that included all three alleged victims. Defense lawyer Walter McKee called Raymond to the stand first thing Wednesday morning and asked his client about his actions at school.

"I did not touch any of these children inappropriately at any time," Raymond said, looking at the jury as he answered each question.

He said the accusation that he slid his hand up the skirt of a second-grader during music class was an accident when he was trying to get her to sit down from a kneeling position. He even reported it to other teachers, he said.

In her testimony Tuesday, that girl said Raymond apologized the first time, but did it again, touching her buttocks over her underpants.

She told her mother, who sent her back to school. She later told a teacher when she was lining up to go back into Raymond's class.

A first grade student at the same school said Raymond squatted and touched her buttocks as she was leaving the portable classroom. On the witness stand Tuesday, she said she told Raymond not to do that and he apologized.

But in a videotape shown in court Wednesday, the same girl was heard telling an interviewer that "he might have been tapping me" good-bye as she exited the trailer.

Raymond said he didn't remember the incident, but said he never crouched down as the kids left the classroom.

A third alleged victim, now 14 years old, told the jury Tuesday that Raymond had touched her leg from ankle to knee one day during a school talent show when the room was dark. He dropped part of a camera on the floor and touched her when he was under the table, she said.

Raymond testified Wednesday that he remembered talking to the girl, but he didn't drop anything on the floor.

"That never occurred," he said.

Contradicting statements he made in a videotaped police interview that prosecutors played for jurors Tuesday, Raymond denied Wednesday having urges to touch the legs and buttocks of little girls. He said he never did any of those things.

He admitted having subscribed to child pornography Web sites.

"I'm not proud that happened," he said.

Those sites featured pictures of nude children, he said. But he stopped visiting those sites after viewing images of children engaged in sex acts, calling it "disgusting."

"I stopped it before it became an addiction," he said.

Raymond said his false confession to Auburn police Detective Chad Syphers last fall was prompted by feelings of intimidation.

"Unless I make some kind of admission to something, I was not going to be leaving this interrogation room," he told the jury. "I was trying to give him a little bit."

Assistant District Attorney Deborah Cashman told the jury in her final argument that Raymond could have simply denied the accusations. Instead, he revealed details that corroborated the allegations.

She told the jury to consider the motives of the witnesses. Only Raymond had an interest in the outcome of the trial, she said. Had the allegations by the three girls not been true, they would have no reason to point a finger at him, she said.

Raymond's attorney questioned the credibility of the girls. Despite the allegations that Raymond's actions took place in rooms full of other people or near them, there were no witnesses to back up their testimony.

One of the girls came forward with her story only after she was prompted by her mother following news accounts of the accusations against Raymond. Another girl told her story years after the alleged incident, McKee said.

Hey Johnny P and the rest of the lynch mob here. Unless you were in the courtroom yesterday you should have NO COMMENT. This article gives you not even 1/2 of what happened in the court room yesterday. (they just wrote the part they wanted to you to hear and twisted it a bit so make it sound 'sinister'). Sinister sells papers, the truth does not. He does not even have some very basic facts correct here. For example, the reporter writes that the 2nd child was from the same school as the first....WRONG....if you can't get basic facts like this straight, what kind of credibility does that give the writer??

I still think he is guilty should never be allowed to teach and be put out to dry! If he and more like him where held accountable for their crimes life for all childern would be better and safer!

I hope sincerly that all the people that have been so negative since last oct. in this case never have to go thru anything similar in your family. You will learn that innocent till proven guilty is nothing but a farce. He has been prosecuted by the press long before the trial begun.

Sorry Johnny P, I didn't say that everything in the article was not the truth, I'm saying the context it has been put into has been twisted. As 'family member' said, he was already prosecuted by the press, do you think the press is going to go an recant what they said even if Raymond provided evidence (not reported in this article) that supported his innocence.

I gotcha. Unfortunately, no. Often times in today's society the press and public prosecute long before any trials. Sometimes, an individuals reputation or even life is ruined due to false accusations. I do not think this is the case here, though.

I don't think this is a case of the public jumping to conclusions- he stated right from the start that he did it and admitted to having a problem. If I remember correctly, immediately after his arrest, people in this blog were defending him- the majority of parents and people who knew him were not persecuting him and hoped it was all a misunderstanding- but then he confessed and that changed everything. So, as far as "innocent until proven guilty", the public heard him say he was guilty a long time ago. I can't imagine what his family is going through, but don't judge the public for our comments- we're just reacting to what the press tells us. What really matters is what the jury thinks - they have all of the facts

Sorry James, we don't buy it. While I strongly believe in innocent until proven guilty and abhor a rush to judgement, you've basically admitted that you're guilty, that you have a prediliction for young girls. Why admit it if not true? Why admit to something that you know is probably going to land you in jail just to terminate an interview? Are you telling us that you're that stupid? Take this opportunity to get help. Use this as your second chance. Yes, it'll be tough. You're done as a teacher, but you can still contribute to society-with help. Get it now, before it's too late.

Does anyone remember about 20 yrs ago when "Sparky" (i think that was his name) worked for the auburn school dept, only to find out he was a child rapist. I remember him, my brother got turoring help from him. They didnt find out till a year later. I clearly remember what that man looks like. It hurt the kids more after they found out what he did in the past. Good to nip it in the bud now, then more than a year from now.

Recap from Yesterday: Ok here's the score James was under investigation for the porn. APD gets wind of this, and the fact that he's a teacher so Syphers goes to the school and starts asking around. Responses he's a great teacher the kids love him they fight over who gets to sit next to him!! Then Chad tells them why he’s asking (likes child porn).everyone no not Mr. Raymond. 2 Days later Families come forward!!!! So Syphers tried and convicted him for the porn, then made it public creating an atmosphere of hysteria where false accusations can start flying and what were before innocent pats on the butt, Now that he's a perv their criminal acts!!! Once the public found out he subscribed to child porn sites (gross and illegal) the witch hunt was on to find a child any child he may have touched in anyway that could be construed as inappropriate regardless of facts or actual intent!! And I really hope this is not a case of parents trying to use their Kids and take advantage of the circumstances for financial gain!!! You know with one of those scum bag Lawyers you all have been talking about!!!

Innocent until proven guilty? OK. He proved it when he confessed. He proved it when he subscribed to child pornography. He proved it when he went baby-shopping at Wal Mart. Sure, you get your trial where the attorneys have to get the ducks in a row, and you get a verdict based on that. Unfortunately, it has nothing to do with guilt or innocence.

Right here!!! Like I said yesterday let the jury decide and they have!! If you all haven’t guessed by now!! I was playing devil's advocate!!! With ISEE I would argue the earth is flat!!! But I do truely believe that pats on the butt where blown out of proportion because of the child porn claims!! And had James Raymond never subscribed to child porn sites he would still be teaching music in Auburn!!

i still think it would have been the right thing to do, if we did not know anything about this man including his name until he was found guilty. if he were innocent right now most of you would label him as guilty. the names should only be released after the verdict of guilty is read.

im sorry, i did not say my thoughts completely. i agree with keeping kids safe and removing the teacher while the investigation is going on, i think the school should know and the police but i think keeping the name private until the guilty verdict is important as well. kids safety is number one of course but if he were innocent he would never be thought of anything short of a molester ever again.

i know what your saying, i would hope that he would remain in police custody or under close monitoring while the investigation was ongoing. as far as he being at walmart, that is unforgivable how the system did not at least have an ankle monitor on him to keep kids safe. this guy deserves what he gets but there have been innnocent people ruined and some have even committed suicide from false accusations and how the public treats them evem after a not guilty verdict. i know i cant have my cake and eat it too, but i wish there was a way to keep our kids safe and keep the innocent safe as well.

I have an idea someone should go to court and get a copy of Raymond's recordered interview with police. Its now public record it can be released. Put the interview on YouTube so we can all make our own decisions. I bet it will make Mr. Raymond look like the perv he really is. Lets see it

I defended a mans right to a fair trial!!! And I was attacked and called a molester and James's Friend and one of the pervs who would victimize children which could not be further from the truth!!! I'm not a hate monger. In fact I was the victim of incest from age 3 to age 13. I just will not listen to excuses or rationales for touching children and viewing child porn. the hate mongers are the ones who take joy in declaring they should be castrated - which wouldn't help, it's a crime of violence, not sex - and those haters would not be happy if the problem were really solved. So I challenge you - form committees on your own! Research! Find a cure! Or is it that you are afraid to lose your scapegoat? Remember, he is a young man and almost certainly will re-offend someday.

i don't believe there is a cure. i am the one with a disease, that is heart disease, the cure for these monsters is prison for life, i saw this earlier in the year a senator with a great idea, put these monsters away for life to do it to each other........he is somewhere in augusta, i can't even remember his name, maybe sj will shed some light on this

This is no joking matter. You all making fun of his actions should rot in jail just like he should. When Jim was a teenager he lived in a household with 2 baby girls. Luckily, their mother knew he was weird (and god forbid he never did anything wrong, just ask him) and NEVER left those girls with this boy. Jim needs professional help, but it will never work as long as he thinks he is innocent. He needs jail time to give him a wake up call. Jim would never make it in jail, he is too weak.
