LEWISTON - A local woman said Wednesday she's prepared to go to jail rather than return a library book about sexuality that she calls "dangerous" to children.
JoAn Karkos, 64, was confined to a courtroom at 8th District Court for about an hour after she was ordered by a judge to hand over the borrowed book: "It's Perfectly Normal: Changing Bodies, Growing Up, Sex and Sexual Health."
Judge Valerie Stanfill revised her order shortly after noon, giving Karkos until the end of the week to produce the property of Lewiston Public Library. Karkos also was ordered to pay a $100 fine within a month.
Talking with reporters outside the courthouse Wednesday, Karkos said she had no intention of giving up the book she claims violates the city's obscenity ordinance. She said the library needs to change its book selection policies to conform with the city's ordinances. She called her actions "civil disobedience."
During her half-hour trial Wednesday morning, Karkos, who represented herself, argued why the book shouldn't be available at the library. Judge Stanfill sustained repeated objections by city attorney Trish McAllister, who said Karkos' arguments were not relevant to the charges.
Stanfill agreed.
"Even if this was the most obscene book ever published in the world, it is not a defense against the charge," Stanfill said. While Karkos offered to pay for the book, Stanfill told Karkos she couldn't force the sale of somebody else's property against their wishes.
Stanfill ruled that Karkos had violated the library's policy and ordered her to return the book. The judge asked Karkos where the book was.
"I have it in my possession," Karkos said. She paused, then repeated that general answer each time the judge pressed her. Finally, Karkos said she had the book with her.
"Then return it right now," Stanfill said.
"I'm going to hang onto the book, your honor," Karkos said.
Stanfill advised Karkos she could be held in contempt of court if she refused to comply with a court order.
"Please return the book," the judge said.
"Your honor, I cannot return the book," Karkos said after a pause.
"I am ordering that book be returned today," Stanfill said. She told Karkos she would have to stay in the courtroom until she gave up the book. After the judge left the bench, a court officer ordered the public out of the courtroom.
Karkos sat in the courtroom until shortly after noon when the judge returned and revised her order, giving Karkos until 4 p.m. Friday to return the book.
Stanfill said she had no intention of hauling away Karkos in handcuffs and making her a martyr for failing to return a library book, said McAllister, who had returned to the courtroom.
Library Director Rick Speer, the only witness other than Karkos to testify during the short trial, said he was pleased with the outcome. "We felt that one person does not have the power to keep the book from 36,000 citizens of Lewiston."
After Karkos' actions were picked up by the media, the library received eight copies of the sexual education book from people around the country, including parents and concerned educators, Speer said.
The book has circulated 48 times over the past 13 years, Speer said. Karkos is the only Lewiston resident to formally complain about the book, he said.
"We believe an educated person is an empowered person," he said.
Speer, who has held his post at the library for 24 years, said Karkos borrowed the book last summer, then sent him a letter saying she planned to keep it because she didn't think it was fit for children. She enclosed a check for $20.95 to cover the cost.
Speer returned her check, explaining that the book was not for sale. He also explained the process she could follow if she believed the book should be pulled from the library's shelf.
Under cross-examination by the city's attorney, Karkos said she didn't bother formally challenging the book's placement.
"Absolutely not," she said. "I knew I didn't stand a chance."
The book, written by Robie H. Harris and illustrated by Michael Emberley, was published in 1993. It features frank but cartoon-like pictures of naked people in chapters on topics such as abstinence, masturbation and sexually transmitted diseases.
Championed by Planned Parenthood and criticized by conservative groups such as Concerned Women for America, the book has been sold in 25 countries and translated into 21 languages.
In her closing arguments, Karkos accused the public library of contributing to an epidemic of sexually transmitted diseases by disseminating prurient information.
"Children are not meant to be sexually active," she said. |

It is the parents role to teach their children about sex. If you want a real eye opener, spend a day in a classroom to see how kids are being sent to school. Many kids aren't fed so the school has to give them breakfast. Kids come to school filthy because parents do not take the time to wash and bathe their kids. The language that kids use today is disrespectful and many times vulgar because that is what is being modeled in the home. I applaud Ms. Karkos on her desire to change something for the benefit of the children. I just don't agree on her methods.

Instead, she is FORCING religious beliefs upon us, WASTING our tax money and taking the well needed time of the court system. She is a hypocrit now; basking in the glamour of attention. What is next, a book deal for herself? This is sick, and we should ignore people like her, not give her the attention she so desperately desires

Another poster stated that she is creating more publicity and more people will want to read it. I would love to hear these statistics. How many people have checked out the new copies that were sent to the library since she started putting up a "stink".

It has been like this for at least 20 years; this behavior of kids around the area is nothing new. If Mrs. Karkos really wanted to make a difference in children's lives, she would volunteer herself in a downtown school or spend the money she will end up having to pay for this stupid demonstration by giving it to a children's charity

While I agree that is essential that parents talk to their children about sex, drugs etc., I'm also not naive enough to believe that all parents *are*. I applaud the children who have an insatiable thirst for knowledge, who are not satisfied with vague answers, cookie cutter answers, etc. I applaud the children who think for themselves, who wonder if there is more knowledge, more information, a different view, a more complete definition/description. I also applaud the parents who encourage their children in the quest for knowledge about themselves and the world around us...let's face it grown-ups...we don't know everything, and even 2 year olds can ask some pretty damn good questions. And, just so we're clear...I do agree that parents should be more acountable, but I do not believe that thievery is the answer. Nor do I believe that one book will be the downfall of our youth. As others said before, there are better, more laudable action to help our youth and their parents, than what Ms. Karkos did.

They use banannas to show kids how to put condoms on. She probably would have a heart attack. Keeping information from kids per her generation (Dont even whisper the word SEX) Caused more teen pregnancys. Our generation NOT EVEN CLOSE. Educate your children.
Just a thought what if she got the rest of the 3 books and threw them away. I bet she would of saved a lot of money and jail time. Probably cost 10 a book.

I think she just took a tool away from the parents wanting to do just that. Certainly there are parents out there unwilling or uncomfortable to talk to their children about sex, and would direct them towards that book. Now she's taken that resource away, and the kids can learn about sexuality from their friends.

Some parents are to shy to talk about sex to their kids, so they find out about it on the streets and from friends. But it's not the best way. So let these kids learn it by reading a book. First of all if they end up at the library, thats a good start, and if it's to read a book, thats even better, and if it's a book on sex just think how embarrassed they are. But they want to learn so let them.... Whats better learning about sex in a book or learning it out on the streets ??.......

I have two adolescent children and although I can write a book and give a speech, I find myself at a loss when taking to my kids about sex. Taking away a tool that parents can use to educate their children (and in some cases, themselves) does not serve the public. She should not only face charges for theft, but should also have to pay all related court costs.

While you speak about the importance and imply the nobility of your cause you have failed to take even the basic steps in making your case. You jumped to civil disobedience and public spectacle. ----- Like all others who resort to civil disobedience the day has come when the legal system has come to the conclusion, as you knew it would, that you have broken the law (indeed, a commandment of God) and must pay the price. ----- Others, both great and small, known and unknown, and right and wrong, have come to this point and received the judgment of the courts. The courts, the representative of the people, have decided that you should return the book. At this point you must comply. Is this about JoAn Karkos or is it about making a point? If it is about you then keep the book. Become heralded by those who agree with you. Become great or maybe greater, in the eyes of some. And let your point become secondary to your personality. The decision is yours.

Society has shaped us into people who just accept the next up and coming trend. So much so that our jr high kids are much more sexually promiscuous then their predecessors just 10 years before.

She's not very smart, there are more in the book stores and other libraries. If she was really passionate about her cause, she would petition all stores and libraries in the state and go through the proper channels to have the book removed or banned. I think she just like's the attention.

If Karkos thinks any child in Lewiston/Auburn is even the tiniest bit safer today because of her actions, she is mistaken. Although I think we might all be a little bit safer come 4PM on Friday.

Because they are uneducated about such things as abstinence and safe sex...they are unaware of their options. We can't keep our kids in the dark about sex, if we did- we would have the same problem of overwhelming new HIV/AIDS cases in this country that Africa has, not to mention..more teen mothers. So many little children in all parts of Africa, are orphaned by the devastating AIDS virus- all because of unsafe sex practices. It's a plague for them!!
My mother explained the birds and the bees to me when I was about 9 y/o.. allowed me to read books about sex, I took Sex Ed in the 6th grade- and I remained a Virgin until I was 25 yrs old, and married!! I wonder if Ms. Karkos is able to say the same...

The point of Ms. Karkos's "civil disobedience" is lost because she didn't (and still won't) avail herself of the legal channels to accomplish her goal. I absolutely disagree with her intention to enforce her perceived moral superiority on the rest of us, but I would have defended her right to challenge the library's polices to the end if she's followed the rules that are already there to do it. Ultimately, all she did is steal a book, and that makes her just another thief.

The fact of the matter is, that parents, mostly conservative ones, are NOT teaching their children or they are telling them a bunch of mistruths. They have to be able to find the FACTS somewhere. So the bottom line is, you would rather have the kids remain ignorant of the facts and not learn about how to avoid pregnancy and sexually transmitted diseases, than to be able to get the straight FACTS in the library. Good thinking!
For Applauding- there's more than one way to stand up for one's beliefs. This lady could have staged a protest outside of the library and garnered more positive attention than what she CHOSE to do. The problem is, she is acting as a censor for all people rather than just her children, or in her case, grand children. Who is she to be the sole arbitor of what's right and moral?
John Berry-civil disobediance. Sure. But she explored NO other alternatives. This was a single, simple-minded act to garner publicity. At that she suceeded. But, again I'll ask, who appointed her the sole arbitor of what's moral?

Why isn't this woman picketing movies, television, magazines, internet, that show more sexual context then the book she holds. Children are 9 and 10 pregnant, this is pre 6th grade where we learn what our body parts are, perhaps this book is used in the positive by an adult that wants to learn proper names to teach their children. I think that this woman as with any others should have her photo on the door to the Libraries in Maine so she can now be banned. (probably she had children by imaculate conception).

She is in contempt of court. The only reason she is not in jail is because the judge didn't want to throw the "old lady" in jail. Age and Sex of the defendant should not matter - LOCK HER UP.

Perhaps we should all have a book burning party for all the offensive books there are to us. How about the college student whom is already educated on the matter but is doing research of some kind? That is just one example of someone using that book that has nothing to do with parenting. She is breaking the law and frivolously using up taxpayers money.

I am so proud of JoAn Karkos. She cares about values and virtues that truly matter and is willing to sacrifice her comfort and her reputation for the sake of the innocence of children while too many are willing to sacrifice the innocence of children for their own comfort. Go ahead and revile her -- all your cursing will visit her as blessings from the only One she cares to please.

She did however make one glaring mistake in not going before the library trustees to ask for the removal of the book. Had she done that and they declied (which they would have) then she could take the protest to the next step and let folks know whats wrong with the book, and THEN as a last resort, sign the book out. As to jail, exactly what will that do? Do you put her in jail until the book is returned, in essence making her a martyr with one more black eye for the city? Simply accept her payment for the book like you would anyone who loses one and move on. But no, someone wants to make a bigger isue of this and it may not be Ms. Karkos. With 8 new copies donated, why not accept the check to pya for the book? Sure would have been cheaper than time spent in court. As to Mmatthew's dumb comments, first there are guidelines on wat my children can and cannot take out under my account at those places if at all, and secondly, they can't view the movie on the spot, which they could do with the book. Part of Ms. Karos concern was that kids were looking at the book in the library and it was not in a place for more appropriate age groups. You simply picked it off the shelf and viewed everything in it. Lastly, how many of you have actually read the book and wondered if you wanted your child looking at it in the library without you there to educate?

Responsible parents aren't going to let their children view this kind of book until it becomes necessary and most parents will talk to their children they do not need a book...

That aside, i am somewhat disappointed by most of the following responses. In 2008 can we not agree that "sex" taught as nothing more than a biological function for pleasure seeking, and the odd child rearing situation is a LIE. There is no "free" sex. There are emotional and physical prices that are encountered. Sex with out morals is dangerous. I often read in these blogs about the children "we" pay for, (price paid) the severe increase in transmitted diseases, (price paid), the amount of NEW diseases since the 1970's (price paid). There is of course emotional damage, as well as lives lost, abortion, (ultimate price paid). I found pornagraphic material when i was 12, it did affect how i looked at women, and how i treated them. A book without moral training is half a cup. Would you hand your son a gun and a book? Or, would you give him first hand training on what he has and the power of good or bad it may cause? As for the "religious rebellious",it is sad,that the fact that the first writings on sexual behavior came from the bible so fears you. Read how it says a man should "Cherish" his wife...more cherishing, less sex.

Exactly where does each of you draw a line for your moral compass and why should you be able to draw a line in that space but Ms, Karkos is considered a kook for standing up for what she beleives?

Posted By:Mark at August 28, 2008 10:51 AM (Suggest Removal) Robert, sure, the library should have every right to consider those types of materials for public use, just like any member of the community has a right to object legally if the library should decide to make them available. I doubt it would take a judge long to have them pulled from the shelves...Defining obscenity by "community standard" is common practice. Ms. Karkos had every right to appeal to the Library's board and ultimately to the courts to have this book or any other removed from the library. What she doesn't have the right to do is decide unilaterally for all of us what should be in library by stealing the book. Personally, I would prefer as little state-sponsored censorship as possible, but I certainly will not stand for any individual citizen providing the censorship.

She could steal your car because it's bad for the environment. She could go and barricade herself in McDonald's to make sure your kids couldn't get any food because they are fat. She could take your computers because your kids could look at porn. Of course this is a stupid exaggeration, but all your reasons for defending her apply to all of these situations.

It's obvious from most of these posts that the eternal destinies of our souls don't even rank as an afterthought for most people. Wake up, people! Heaven exists, but so does hell! Do all you can to ensure that sex remains a holy act between a husband and wife who are lawfully married before God, and not a public disgrace just done by anyone, with anyone, just to satisfy lust and a prurient nature. Society owes it to kids to protect their innocence for as long as possible, and pornographic cartoons are not the way to teach kids about sex. If you want to teach sex the right way, learn the Catholic teaching on the subject, and then pass it on to your kids. It's part of your duty as a parent, and it will be part of your judgment when you meet Jesus Christ.

Stealing food in order to feed your starving family is considered a minor sin which will not keep you from heaven. Stealing a book (which Ms. Karkos in good faith tried to pay for) which steals innocence away from children would have to be considered at worst in the same category as the above-mentioned theft of food. Ms. Karkos has done what is right in the eyes of God. The library's reaction to what she did is shameful.
