The inmates deserve their day in court to lay out whatever evidence (witness statements, medical records, expert opinions...) they have in support of their claim and obviously thier own criminal histories (felonies, crimes of dishonesty) are relevant in assessing their credibility. While I do not believe that either the DOC or AG's office are incapable or unwilling to find fault with jail personnel, maybe they have not initiated thier own investigations because the inmates never filed a complaint with either entity, instead deciding to bring the matter directly to civil court.
Regardless of the original intention of the Act, it makes little sense not to at least explore the idea of means testing, at least for those recipients who have more than $500,000 in savings or assets. No one at or above that level needs a monthly check from the government even if they did pay into the system. Unfortunately, nobody has the will to propose such a plan given the monolithic voting power of the AARP and related lobbies.

My point is not that the choice of Petraeus was unwise, but rather that his sudden rehabilitation of character in liberal circles now that he will be presumably 'cooking the books' for a Democratic Whitehouse just goes to show how little those who organized the original smear campaign against him actually knew or cared about his capabilities.
