The truth about costly "Industrial Wind Complexes",

LePage just articulates what Rooks and his wind  obfuscators and deceivers  do not want anyone to hear.
Wind is free, but the Industrial wind complexes are not.

They are only called “ wind farms” because Rooks and friends are milking the subsidies and the PTC's and other financial benefits from us , the taxpayers .

From their costly rare earth metals (from mainly China), to mountaintop  environmental destruction, wind is very costly to this society.

 In the attempt to harness low density wind to create electricity, all along the way, the costs mount, and the dollars are dense indeed .

 All winds costs are upfront Rooks declares, but doesn't say where the money comes from.

I suppose we taxpayers  are the ones who pay the upfront costs and  prevent the likes of snake-oil salesman King from taking the risk.  First Wind  and other subsidy scammers of this unsavory  hedging plot and risk lowering LLC creators  take our money and laugh all to the their foreign accounts

From the billions in unneeded wind  transmission lines ,  to the damage of  abutter land  value and health consequences from infra-sound to the low job creation at high unit cost, wind is not cheap for anyone.

The minor benefits are overridden by the numerous costs to society in the long run.

 But why worry about this, when tens of millions can be scammed to the elitists from a fad that will be dead in this decade?
 The natural gas will flow, and the oil production will grow, and the wind will blow.
The subsidy money is finite however, as Congress now realizes this Mr. Rooks.

Laws cannot be violated because of "the deal"

In reference to the merger of Emera/First Wind/Algonquin / others , concerning PUC Doc 2011-170.

Guess what, even First Wind, (Enron's Bastard Son), bathed in special treatment in Maine by the expedited wind law, has to follow the laws of this state. The deal hopefully will be killed, as detrimental to all Maine citizens. It would result in increased costs of electricity for all, from feckless wind scamming. Fortunately, our Public Advocate, Eric Bryant, is doing his job, even if the Sun Journal, Portland Press Herald, as well as the Bangor Daily (BTW, part of the aboove case) are not.

So, look into the public minutes of this testimony. Fitst Wind is in big trouble, now under appeal by them as a sore loser. The appeal hopefully will be thrown out. They defied subpoena of documents as well, relating to Kurt Adams .

The deal should be dead, dead. In addition First Wind should be banned and sanctioned from any further business in this state.That may occur.

The first and second laws of thermodynamics cannot be overcome by NON-DENSE,(low-density) electron sources, such as onshore, or offshore wind toys.
Just as Mr. Obama's tune had to change when applying science to energy(which he and his advisors may sometimes think about), if we did not have high levels of domestic energy sources available, we would have to invent them. There is no substitute for oil and natural gas, and he knows this. He also knows there are plenty of them as well, we just have to get them, politics aside.

Obama has to pander to his scientifically naive liberal base for politics, but politics won't power American modernity, ever.He had to get real.

So Anabel, please tell me how offshore wind meets any of the below requirements, any electrical utility knows must be met to turn on your lights, when and if you need them.
Dense energy sources are needed to power modernity.(period)

How does wind meet the criteria every electrical generating source must meet?
Any electric utility must meet the following, well known in the industry to survive.
1.The source must provide large amounts of electrons (it must be dense)
2.The power must be reliable and predictable.
3.The electrons must be dispatchable (high or low amount must be generated on demand)
4.It must serve one or more grid demand elements(base load, load following and peak load).
5.The utilization of environment must be minimal and compactness is a must, or it is non-green and damaging the environment.
6.It must be economical

Can an intermittent source like feckless wind meet these numerous demands?

There is a place for wind and solar (independent residential of industrial use is sometimes economical, but costly), but GRID SCALE....nope.

Oh, when LePage allows the Renewable Option to be selected for use as Your energy supplier, please request the renewable option at a 30 percent premium!

Your neighbor most likely will stick to the standard offer, derived mainly from natural gas and hydro, and nuclear.

Administrative agencies, according to the United States Supreme Court, are based on concepts of fair play. We come to this agency with a trust that this Commission and the staff are going to require the parties to play by the rules and play on a level playing field and not proceed in a case in a manner that all they seek to do is win at all costs regardless of what they do. It is so clear what has happened here, as aptly summarized by Eric, by Charlie, and by Tony. It literally makes me sick.

There is no way that we can proceed in this case. The record is tainted. We can't just simply re-open the record to allow them to change the deal when they want to change the deal because they're losing. I mean, to reward, as Tony said, the Petitioners and First Wind and APUC would be terrible, in a word. It would undermine the confidence in this agency, and what this Commission is trying to prevent with regard to this deal is undermine the confidence in the market. You don't
undermine the confidence in the agency.

This is only one group of people's fault. It was a deliberate action. If this were a court of law, this case would be dismissed in a moment. You can't get to a jury five minutes before and say, oops, I screwed up, I should have put more evidence in and then inflict some conduct that causes a mistrial and expect to start all over again. No court would allow that. They would dismiss it with prejudice, and that would be the end of it. And they would impose sanctions and serious ones.

...So the way forward is to simply say no, this deal we've been looking at, this transaction, is only an economic deal to benefit First Wind and Emera. It's not a reliability issue. The question is harm. Well, we know how harmed we're going to be now. If you can't trust these people to comply with the fundamental rules of this Commission, how can you trust them to do anything in the ratepayers' interest? They've proven this point. Mr. Harwood can have all his responses to everything that we've said, but I think the truth will shine through clearly and does. So I join on behalf of Houlton Water Company with the motions that have been made to dismiss this proceeding with prejudice and, in addition, so the record is clear, to strike Petitioners' comments and exceptions in their entirety. If the -- when I say dismiss with prejudice, if there's some other deal that comes together later on that is significantly different from this deal and that is not just a re-packaging to get around a denial, then maybe this Commission might look at it, maybe they won't. But that's for a future date. Right now the remedy is to dismiss it with prejudice.

The rules violated are rules of integrity, fundamental fairness and substance, not mere housekeeping rules designed to advance administrative efficiency"

Petitioners violated Chapter 110 section 760-A(a) and (d~ of the Commission’s Rules. The filing of “exceptions” by APUC and First Wind violated the Ex Parte rule under Section 760-A(a) Petitioners’ subornation of these filings, as evidenced by the references to the filings in Petitioners Exceptions, also violates Section 760-A(d) which reads

No party in a proceeding shall request, encourage, suggest, or provide any assistance to any other person to make a communication that would violate subsection (a) of this section.

8Petitioners chose to engage in coordinated, concerted action with First Wind and APUC to assist them in an improper attempt to have a non-party influence the Commission after the date for filing exceptions, and to inject non-record information into evidence, and to couple this with a direct violation by commingling the prejudicial material into Petitioners own Exceptions. Petitioners deliberately cited to, quoted from, and indeed made such filings a part of their own January 23, 2012 Exceptions. Their awareness of procedural issues is revealed by the first footnote in their Exceptions. Petitioners’ actions were willful, ~vith the expectation that opposing parties would have no opportunity to respond,7 and for the primary purpose of influencing this Commission’s decision.

(“Boralex”)(collectively, the “intervenors”) by and through their respective attorneys and move to dismiss these proceedings or to enter judgment against Bangor Hydro Electric Company and Maine Public Service Company (“Petitioners”) based upon the recommended findings of the Examiners~ Report.

I. INTRODUCTION

Petitioners have intentionally and recklessly violated the Commission’s Rules of Practice and the Examiners’ January 19, 2011 Scheduling Order by filing Exceptions tainted by prejudicial non-record information and by assisting and/or encouraging First Wind Holdings, LLC (“First Wind”) and Algonquin Power & Utilities Corp. (“APUC”) to file unauthorized comments doing the same. According to the Examiners, these exceptions have been reviewed by the Commissioners. As described herein, further consideration of the case at this point would violate fundamental principles of due process and would be unduly prejudicial to the intervenors in this case. Of equal importance is the fact that the actions of the Petitioners, First Wind and Algonquin Power have damaged the integrity of the adjudicatory process by intentionally exposing the Commissioners and their advisors to information outside of the record that, even if the Commission can ignore, undermines public confidence in the process. Dismissal with prejudice orjudgment against Petitioners are the appropriate remedies and sanctions for Petitioners’ violations of the Commission’s Rules and the January 19 Schedul

How does wind power meet the criteria every electrical generating source must meet?

 Any electric utility must meet the following, well known in the industry to survive.

3.The electrons must be dispatchable (high or low amount must be generated on demand)
4.It must serve one or more grid demand elements(base load, load following and peak load).

The above 132 MW wind turbine facility, capital cost $330 million, is owned by TransCanada and was built, after a lot of destruction, on one of the most beautiful ridge lines in Maine. TransCanada and Vestas the claimed that the capacity factor would be 0.32, or greater. It was placed in service on 10/31/2009.

Its FERC designation is Trans Canadian Wind Development, Inc. in case you want to look up the below data.

In 2009 and 2010, the facility had a lot of startup problems and its energy production was negligible.
In 2011, it had a capacity factor of 22.5% for the first 9 months.
For the 3rd quarter of 2011, it was 14.42%. Monthly capacity factors were as follows:
July 18.48%
Aug 12.31%
Sept 12.41%

Why are the CFs so low?

Winds on ridge lines have highly-irregular velocities AND directions. This does not show up when one does wind velocity testing for feasibility, but when rotors are 373 feet in diameter, one part of a rotor will likely see a different wind velocity AND direction from another part. This leads to highly inefficient energy production and CFs. Wind vendors are very familiar with this, but do not mention it. However, all is explained in this article. I recommend the VT-DPS and House Environment and Energy Committee, and all others, finally read this article, before "leading" Vermont into an expensive energy la-la-land.

Jon Hinck is married to Juliet Browne who is a lawyer and partner at Verill Dana whose main practice deals with the defense of wind power companies .She has been extremely busy in the past few years representing wind developers on the local level, before Maine DEP ,and LURC and defending the companies in numerous appeals and lawsuits . She has represented First Wind, TransCanada and Independence Wind and is quite possibly the wind industry’s leading attorney in Maine.

Alex Cornell du Houx, an avid supporter of wind power, is the outreach coordinator of the Truman National Security Project. This organization states a deep philosophical belief that climate change is a national security threat. On that subject one of their position papers includes the following statement concerning the threat of climate change to our country’s national security, "Even if you do not have complete information, you still need to take action! Waiting for 100% certainty during a crisis can be disastrous." That sounds awfully like, “Shoot first then ask questions “. A sister organization of the Truman National Security Project is Operation Free, where Mr. Du Houx serves as Campaign Director. Operation Free lists as its first core motivational principal “get America running on clean energy”. In fact, the organization’s logo prominently features industrial wind turbines.

Stacey Fitts, co-chair of the Joint Standing Committee on
Energy, Utilities and Technology, works for Kleinschmidt Associates, an engineering, licensing, environmental service firm offering specialized technical services to the renewable industry. Attached to this email is some information regarding that firm. Kleinschmidt’s wind focus is primarily off -shore wind power, but the Energy, Utilities and Technology Committee makes decisions on offshore wind and decisions made for offshore wind will benefit onshore, such as anything that helps along large transmission projects. Co-Chair Fitts was quoted in the February 7, 2011 Sun-Journal as saying "Everyone wants to find the conflict, the snake in the grass. But every legislator in the building is conflicted if you were to take that same standard and apply it to everyone else. It’s the nature of being part-time legislators."

But what happens when the legislator’s employer actively approves of its employee’s work as a legislator and perhaps encourages such legislative endeavors to exceed simple part-time work? As can be seen above, Kleinschmidt’s website brazenly boasts, “we have been very active in the development of state regulations in Maine where one of Kleinschmidt’s engineers is a member of the Governor’s Ocean Energy Task Force.

In 2007,wind produced 31 million MW-hrs! (EIA data), at $23.37 subsidized per MW-hr !
The wind power sector therefore got 93 times as much in federal subsidies as natural gas , even though the natural gas sector produced 28 times more electricity than wind, of high value base load!
Remember gas gets .$25 (25 cents)mW-hr.Wind got $23.37 MW-hr subsidization
Gas generated 900 million MW-hrs! Gas was subsidized 25 cents ($.25) per MW hr.

Are any selectmen self-servers?

...Remember, Maine has no such ethics laws, and indeed, a cash transfer to a town father would have to be caught on camera to declare it a violation of ethics in Maine, as Maine basically has no law in this area?
Because of the scope, size, environmental impacts, health and property value impacts, and potential permanent changes to this rural community, we the People of Lincoln(applies to all towns in Maine) and surrounding communities must know all the facts, so we, the citizens, are sure that all the standards of ethics and integrity of legal process have been upheld. The history of the dealings of the above aforementioned company must be completely scrutinized, as is being done in New York State at this moment. We have every reason to believe, and do insist, that the Code of Ethics governing these companies recently adopted in New York State be applied in Maine to assure that the public is properly protected and has the time to fairly evaluate the values and pitfalls of this new industry to our area.

We therefore request that the Attorney General of Maine establish this code that:

1.Bans wind companies from hiring municipal employees or their relatives, giving gifts of more than $10 during a one-year period, or providing any other form of compensation that is contingent on any action before a municipal agency.

2.Prevents wind companies from soliciting, using, or knowingly receiving confidential information acquired by a municipal officer in the course of his or her official duties.

3.Requires wind companies to establish and maintain a public web site to disclose the names of all municipal officers or their relatives who have a financial stake in wind turbine development.

4.Requires wind companies to submit in writing to the municipal clerk for public inspection and to publish in the local newspaper the nature and scope of the municipal officers financial interest.

5.Mandates that all wind easements and leases are in writing and filed with the County Clerk.

6.Dictates that within thirty days of signing the Wind Industry of Maine Code of Ethics, companies must conduct a seminar for employees about identifying and preventing conflicts of interest when working with municipal employees.

In addition, the establishment of a Citizen Review Board with direct legal consul from the Attorney General will be created to oversee and monitor the above Code within Maine.

The above Maine Ethics Code for Wind Industry companies is essentially the same as that which Attorney General Cuomo of New York State established on October 30, 2008. It was created because of the ongoing legal investigations initiated by citizens against First Wind and Noble Environmental Power in New York State. These investigations remain ongoing.

The Citizens of Maine must have this code to ensure that fair and ethical dealings be established by Windpower companies in Maine with it citizenry.
We cannot allow the ‘Windrush’ in Maine to undermine integrity of legal process, as well as impact communities in a multitude of ways,some of which may be detrimental , without a full , transparent process in place.
At this moment no such process exists in Maine. We insist on a statewide moratorium on wind development until the Maine Ethics Code for the Wind Industry is established.

Have an ethics code as a precondition with all selectmen and developers.

Follow this :

1. Do you have, had or will have benefited financially from this or other wind projects in your area?
Are you a self-server?

2. Do you know if the selectmen have had secret meetings, financial dealings or other arrangements with representatives of First Wind in crafting this ordinance, and can they meet the transparency and ethics standards as put forth in my post below, (which are indeed the law in NY State). Are any selectmen self-servers?

...Remember, Maine has no such ethics laws, and indeed, a cash transfer to a town father would have to be caught on camera to declare it a violation of ethics in Maine, as Maine basically has no law in this area?
Because of the scope, size, environmental impacts, health and property value impacts, and potential permanent changes to this rural community, we the People of Lincoln(applies to all towns in Maine) and surrounding communities must know all the facts, so we, the citizens, are sure that all the standards of ethics and integrity of legal process have been upheld. The history of the dealings of the above aforementioned company must be completely scrutinized, as is being done in New York State at this moment. We have every reason to believe, and do insist, that the Code of Ethics governing these companies recently adopted in New York State be applied in Maine to assure that the public is properly protected and has the time to fairly evaluate the values and pitfalls of this new industry to our area.

We therefore request that the Attorney General of Maine establish this code that:

1.Bans wind companies from hiring municipal employees or their relatives, giving gifts of more than $10 during a one-year period, or providing any other form of compensation that is contingent on any action before a municipal agency.

2.Prevents wind companies from soliciting, using, or knowingly receiving confidential information acquired by a municipal officer in the course of his or her official duties.

3.Requires wind companies to establish and maintain a public web site to disclose the names of all municipal officers or their relatives who have a financial stake in wind turbine development.

4.Requires wind companies to submit in writing to the municipal clerk for public inspection and to publish in the local newspaper the nature and scope of the municipal officers financial interest.

5.Mandates that all wind easements and leases are in writing and filed with the County Clerk.

6.Dictates that within thirty days of signing the Wind Industry of Maine Code of Ethics, companies must conduct a seminar for employees about identifying and preventing conflicts of interest when working with municipal employees.

In addition, the establishment of a Citizen Review Board with direct legal consul from the Attorney General will be created to oversee and monitor the above Code within Maine.

The above Maine Ethics Code for Wind Industry companies is essentially the same as that which Attorney General Cuomo of New York State established on October 30, 2008. It was created because of the ongoing legal investigations initiated by citizens against First Wind and Noble Environmental Power in New York State. These investigations remain ongoing.

The Citizens of Maine must have this code to ensure that fair and ethical dealings be established by Windpower companies in Maine with it citizenry.
We cannot allow the ‘Windrush’ in Maine to undermine integrity of legal process, as well as impact communities in a multitude of ways,some of which may be detrimental , without a full , transparent process in place.
At this moment no such process exists in Maine. We insist on a statewide moratorium on wind development until the Maine Ethics Code for the Wind Industry is established.

Exxon Mobil Corp.'s huge new oil discovery in the Gulf of Mexico is good news for domestic energy production, but it's even better news as a sign that last year's panic over the BP spill won't continue to cripple American offshore oil exploration. Every so often, reality triumphs over politics.

Exxon had been ready to drill on the site last year before the Obama Administration shut down all deepwater drilling in the wake of the BP spill. The Interior Department is still issuing very few permits, only 15 for new wells since it lifted its moratorium in October, but Exxon received one of them and struck black gold at 7,000 feet below sea level and some 230 miles at sea.

That's nearly 3,000 feet deeper than BP's Macondo well and shows how technology and innovation have opened up oil and gas resources that were impossible to detect, much less reach and develop, only a few years ago. Exxon estimates the field contains some 700 million barrels of oil equivalent, one of the largest finds of the last decade.
The great energy irony of recent years is that governments have thrown hundreds of billions of dollars at wind, solar, ethanol and other alternative fuels, yet the major breakthroughs have taken place in the traditional oil and natural gas business. Hydraulic fracturing in shale, horizontal drilling and new seismic techniques are only the best known examples.
Private companies must innovate to survive, and they have the profit incentive to do so, while government cash is usually steered to politically favored companies that may or may not know what they're doing. If you live off federal grants, you need to work the corridors of power more than the technology. Federal grants for cellulosic ethanol are rife with political earmarks, for example. This is why these columns have argued that the political fad of alternative energy has misallocated scarce capital when the economy can least afford it.
The risk of oil spills has not vanished. But one lesson of the BP debacle is that better management and practices could have prevented it. The Obama Administration is making it harder to obtain permits, which will eliminate all but the biggest companies from deepwater drilling and (unfortunately) raise the cost of production.

Far more important for safety is the effort that the oil industry is taking to contain future deepwater spills. ConocoPhillips, Exxon, Shell and Chevron have led an effort, since joined by other companies, to form the Marine Well Containment Co. to build a spill containment system that will be permanently placed in the Gulf starting next year.
The companies are attempting to apply the lessons from the BP fiasco, and their expectation is that the system would be able to handle a blowout as if it were a contained well at depths of up to 10,000 feet. The companies have committed $1 billion to the project, and we're told the cost could reach $1.5 billion. If you believe Big Oil companies are inherently evil, you'll think this is one more confidence trick. But no rational company or CEO wants to endure the reputational damage that accompanied the BP spill.

The Exxon discovery is a display of the animal spirits that still live in the U.S. energy industry, notwithstanding the political efforts to stifle them. As much as Washington tries, the U.S. economy is hard to keep down.

In 2007, natural gas fired electricity got just .$25 per megawatt hour federal subsidization and natural gas produced more than 900 million megawatt hours of electricity on demand , base load 24/7/365 days a year! (EIA official stats).
In 2007,wind produced 31 million MW-hrs! (EIA data), at $23.37 subsidized per MW-hr !
The wind power sector therefore got 93 times as much in federal subsidies as natural gas , even though the natural gas sector produced 28 times more electricity than wind, of high value base load!
Remember gas gets .$25 (25 cents)mW-hr.Wind got $23.37 MW-hr subsidization
Gas generated 900 million MW-hrs! Gas was subsidized 25 cents ($.25) per MW hr.
Feckless wind generated 31 million Mg-watt hours! Subsidized $23.37 per MW-hr!

And also remember, natural gas was available 24/7/365, wind has no base load capacity. Wind is highly intermittent and was not available on demand and has no base load capacity.

WE CAN’T AFFORD THE WIND FARCE ANY LONGER! Business cannot afford power at over double the price, sometimes when the wind blows!

Gas, Hydro, other high density sources of electrons are the only way to go.
And the new domestic shale gas reserves of 2500 trillion cubic feet will last this country a very long time!

We subsized First Wind at high levels, upwards of 70 percent, WITH OUR U.S. DOLLARS.
They build projects with our federal taxes , "tax incremental funding" dumb towns give them more local tax money and give away their municipal taxes for multimilion dollar projects, so First Wind can get more tax breaks with our dollars.
The towns smile because they get a new fire engine from the deal. The taxes of the town go up, because of lost tax base.

First Wind buys Chinese Turbines with our U.S. dollars, and then spin the company and development dollar to Canadian companies (or Spanish in the case of CMP) as we then PAY for THE POWER LINES to deliver next to no power, feckless power out of state.

Some temporary construction jobs are created, and we call it job growth in MAINE!
I guess this state even dumber than it is desperate.

We Mainers THEN PAY THE HIGHER electric RATES for power AGAIN, AND WE ALLOW BREACHING MAINE LAW with this combination of a generator and a transmission company (Bangor Hydro), and rates go up again FOR MAINERS!

But we do get the wind sprawl and financial and ecologic damage, and the sole of the state is destroyed. Vacationland dies a slow death to the wind.

Not only are WE BROKE FROM THIS ENRON SCAM, WE ARE DUMB TO PERMIT IT to continue!

NOTE, First Wind now has more projects in Maine (and growing), than ANY state in New England.

Rumford, Study what happened in Lincoln

because, it is now happening to YOU!

This is what people should know about the handling of the Rollins Wind project. It should set off alarms with anyone who values the ideal of participatory democracy and has a sense of fairness.

1. It is the first project that was rammed through as a result of the heinous Expedited Wind Permitting statute, which has opened the floodgates for the proliferation of these projects, a giveaway of rural Maine to an industry that wouldn't exist without extensive Taxpayer subsidies and preferential treatment.

2. First Wind was wooing Lincoln elected and appointed public officials for more than 6 years before announcement of their plans. Instead of being responsible public servants and sponsoring an extensive public examination of the issues, they did everything possible to open the door to a company with questionable reputation.

3. The only public forum ever held in Lincoln was a carefully controlled First Wind "Dog & Pony Show" that raised more questions than provided answers to any citizens who asked questions rather than just accept the company's propaganda.

4. After First Wind's intentions became clear in September of 2008, the Lincoln Town Council refused to enact a Moratorium to provide the community with an opportunity to consider the multiplicity of issues raised by a citizens' group and within two months, the First Wind application was deemed "complete" and the countdown under the Expedited Wind Permitting began relentlessly.

5. One single copy of the huge, 3-volume application was available to read at Town Hall, but the Planning Board, so eager to do the bidding of First Wind, set a hearing on the application for the absolute minimum number of days for public notice. The compact disc and on-line versions of the mind-numbing detail in the application was available only 3 days before the public hearing.

6. At the public hearing, the Chairman of the Planning Board refused to recuse himself over conflict of interest, that being, he was the realtor who represented the major landowner as lessor for parcels included in First Wind leases. The citizens were given 2 minutes each to comment on the complex application. The chairman and a stalwart zealot on behalf of First Wind attempted to ram through a vote that very night until one Planning Board member questioned whether Board members had read what they were about to vote on. When they admitted they hadn't, the vote was postponed.

7. When the Planning Board met 2 weeks later, no further public comments were allowed, yet when questions were asked of representatives of First Wind, the company was allowed unrestrained time to advocate for the project. The application was quickly pushed through for approval. A huge, community-altering change to the Lincoln Lakes area approved with about the same consideration as someone proposing to add a tool shed to his or her property!

8. The Town Council approved the Planning Board's decision in a meeting where citizens were given 5 minutes each for comments, doing so even when it was faced with an even larger crowd asking questions critical of the project. First Wind officials were not subject to the Egg Timer and was unfettered in its obvious advocacy for approval.

9. The Lincoln Town Council agreed to have First Wind pay for the town's lawyer at Eaton Peabody to negotiate the TIF agreement with First Wind's lawyer at Eaton Peabody and rubber stamped the resulting give back of 50% of the property taxes to be generated.

10. The Appeals Board in Lincoln strategized with First Wind to attack and discredit the citizens group and voted that the hastily organized group lacked standing to appeal the Planning Board's decision to violate Lincoln's Land Use Ordinance in approving an industrial development in a rural residential zone.

11. The follow through on this horrendous un-civic process at the state level has been as bad. It started with the DEP refusing to hold a formal hearing where sworn testimony and cross-examination can take place. To date, throughout the state, this has been the case because the Expedited Wind Permitting statute does not allow it. DEP only has a local "meeting" to allow citizens to raise questions and make comments, most of which are answered with wind industry propaganda or no answer at all.

12. The DEP staff and the Board of Environmental Protection (and LURC in non-DEP jurisdictions) have clearly been marching to the orders of Baldacci, who has made proliferation of the wind industry his legacy. It is abundantly clear that state workers fear speaking out of line and the BEP members, all Baldacci appointees, are following through to allow the environment of rural Maine to be devastated by at least 45 projects the size of the Rollins project in Lincoln Lakes.

13. The courts have turned their backs on the serious issues raised by citizen groups. The State Supreme Judicial Court, even after several members pointedly examined the issues, voted to say the Expedited Wind Permitting statute is the will of the Legislature (which voted it through as a last minute, non-publicized, bill in the short session of the Legislature in April 2008) and they would not rule against it.

So here we are, with an undeserving company that steamrolled over local officials, handed the undue opportunity to ruin a beautiful corner of Maine. Sadly, Lincoln has failed and it will never be the same. When the First Wind project is finished and the impact gets realized, in Lincoln there will be a lot of regrets expressed.

It is not really the Wind Power issue in Maine or” Green Jobs”, it is the “GREENBACK”, out of the citizens pockets, into vested special interests deceptive coffers.
