ALFRED — A lawyer for a 39-year-old Maine man charged with murder in the fatal shooting of his wife says the shooting was an accident.

David Van Dyke told WMTW-TV that Patrick Dapolito told him that a gun accidentally discharged and the bullet struck his wife, 30-year-old Kelly Winslow-Dapolito, in the head on March 16 at their home in Limington.

Dapolito reported his wife missing two days later and was charged with murder on Saturday. He was due to make his first court appearance Monday in York County Superior Court in Alfred.

Van Dyke said Dapolito told him he led detectives to his wife’s body in Upton and waited so long to contact police because he was so shocked after witnessing his wife’s death.
