AUGUSTA, (AP) – A lawyer for actor Aidan Quinn moved during a pretrial hearing to suppress evidence gathered after the actor was pulled over for erratic driving.
Quinn was arrested and charged with drunken driving in Waterville last fall after leaving the Bread Box Cafe, where there was a late-night gathering of people involved in the filming of the HBO movie “Empire Falls.”
A Waterville police officer stopped Quinn’s car and detained him without sufficient reason, attorney Michaela Murphy said during Tuesday’s hearing in Kennebec County Superior Court.
Quinn was not in court for the hearing before Justice Donald Marden.
Former Waterville police officer Steven Pelletier said he began following the car after it appeared to run a stop sign.
He said he followed the rented silver Chevrolet Impala for almost three miles along Silver Street and onto Kennedy Memorial Drive at about 2 a.m. on Oct. 24.
Pelletier said the car was drifting in the lane, and speeding. He said he did not use radar when measuring the car’s speed, but matched his speed to its.
He said he pulled the car over for going about 50 mph in a 35 mph zone, and learned Quinn was driving the car when he handed over his license.
Pelletier said he conducted a field sobriety test that determined Quinn was intoxicated, then brought the actor to the Waterville Police Department for booking.
Murphy played a booking room videotape in which police officers were heard laughing as Pelletier tells a fellow officer he stopped Quinn for going 25 in a 40-mph zone.
She and Assistant District Attorney Brad Grant agreed to present written final arguments by Aug. 9.
Quinn was released on bail after his arrest and has since entered a plea of not guilty.
