BETHEL – Planners voted 5-0 Wednesday night that because the owner of the Funky Red Barn bar withdrew his request for an outside horseshoe court, the case is moot and no decision on a site plan review is necessary.

The board was asked to determine change of use applicability regarding Barry J. Hallett Jr.’s bar at 19 Summer St.

Earlier this summer, Hallett sought an amendment to the bar’s liquor license to allow outside horseshoe pits to be created in the bar’s parking lot, and to allow patrons to drink alcohol there.

Bethel selectmen endorsed it on July 14 and it was OK’d by the Maine Liquor Licensing and Inspection Division. However, when an abutter asked planners to determine applicability of Bethel’s site plan review, Hallett withdrew his request.

Selectmen and the state liquor licensing agency then revoked their approvals.

At Wednesday night’s meeting, Planner Francis Dumont argued that the matter was made moot when Hallett withdrew the request.

Planning Board Vice Chairman Jon Cowan said a change of use occurred on one day prior to Hallett rescinding his request, but because no horseshoe pits were built and no changes made to the bar, the board had nothing on which to act.

In other business, planners unanimously gave Gretchen Anderson a building permit to replace windows and a door of the Bingham House, which she and her husband purchased.

They also OK’d construction of a fenced parapet on one side of the 19th century house on Broad Street in Bethel’s Historic District to match one on the other side.

Planners also decided that Earl Tyler’s proposed Grand View Estates, Phase II project documents package is complete.

Represented by Robert Berry III of Main-Land Development Consultants Inc. of Livermore Falls, Tyler wants to create and sell 14 additional 1- and 2-acre lots for single-family residential homes on a nearly 17-acre parcel. Additionally, he’s proposing to construct a 1,200-foot-long road with a cul-de-sac turnaround to access the lots.

The road would leave Valley View Drive from Grand View Road off the Intervale Road.

Planners scheduled a site walk of the project area for 5 p.m. Wednesday, Oct. 1, and a public hearing for 6:30 p.m. on Wednesday, Oct. 8, in the town office. The regular board meeting will follow at 7 p.m.
