FARMINGTON — A local man accused of choking  and restraining a woman in late August was indicted Wednesday by a grand jury.

Benjamin Rush, 30, of Farmington was charged with aggravated assault and criminal restraint. Farmington police initially charged him with the assault charge and kidnapping. A conviction on the assault charges carries up to 10 years in prison.

Rush was arrested after a fight between him and a woman escalated, Deputy Chief Shane Cote said.

Apparently, they were fighting at a local bar and after going home, the fight got physical, Cote said.

Rush choked her inside the house, and she tried to leave, Cote said. After she got into her car, Rush dragged her out by the neck and choked her again by the side of the house, Cote said.

She walked away, but he got into her car. He then apparently intimidated her and made her get back into the car, Cote said.

The woman refused medical treatment, although she appeared to have a hard time breathing, the deputy chief said at the time.
