LISBON — Town councilors will consider Lorelei Hilliker’s complaint requesting that they revoke Lisbon Cannabis Company’s license to operate its medical marijuana dispensary at 5 Canal St.

There was no discussion among councilors as they voted at their Oct. 1 meeting to consider the revocation at a later meeting – Norm Albert was absent and Fern Larochelle abstained from voting on the agenda item as he has personal interest in the property at the center of the request.

There was also an executive session, which Larochelle did not attend, at the beginning of the meeting to consult with the town attorney.

Hilliker’s attorney, Bradford Pattershall, argued in a July 29 letter to the town that Lisbon Cannabis owner Jason Smith did not provide sufficient evidence in his town license application to operate his cannabis business out of the building. Hilliker owns 207 Edibles, which also operates out of 5 Canal St.

Smith and Hilliker own equal membership share interests in Riverbend Investment Properties LLC, which owns the building at 5 Canal St., according to the letter. The two have a pending lawsuit to dissolve Riverbend because of disagreements in operational decisions.

Though Smith owns 50% membership interest in Riverbend, he is not the owner, Pattershall argued. Pattershall argues that Smith has no lease or agreement with Riverbend to operate his store and the operational disputes between Hilliker and Smith prevent Riverbend from giving the written consent needed to operate his marijuana business out of the building.

Pattershall is asking that Smith’s license to operate be suspended or revoked until he can provide written consent from Riverbend to operate out of the building, according to the letter.

He also argues that the town failed to provide sufficient notice of a public hearing for the application license before it was approved by councilors last spring – another reason to suspend or revoke Lisbon Cannabis’ license. Smith’s attorney, Jonathan Berry, questioned if that type of public notice is required for a license renewal.

Berry argued that the operating agreement between Smith and Hilliker for Riverbend allows the two to act individually in carrying out certain types of business and that Smith does not need to get written agreement from Riverbend to operate his business out of 5 Canal St.

In another matter, councilor and Water Commission liaison Raymond Robishaw updated councilors on the Water Commission, stating that the PUC received a 10-person complaint about the Lisbon Water Department, which is working now to address those complaints. That case number is 2024-00255, he said.

A new water department employee will start next week, and the commission is looking to take out a $148,000 bond to update the water system, he said. Robishaw did not go into detail about what specific upgrades that bond would fund.
