PARIS — The Select Board on Monday voted to remove itself from the lawsuit filed against Maine School Administrative District 17.

Town officials had joined West Paris late last year in the lawsuit. Lawyers for both Paris and West Paris contended in the legal complaint that SAD 17 violated Maine law when Superintendent Heather Manchester closed Agnes Gray Elementary School in West Paris last February due to unsafe conditions. The condition of the building was outlined in an inspection report prepared by Portland firm LaVallee Brensinger Architects.

The SAD 17 Board of Directors voted 19-1 in October against allocating up to $6 million in repairs to make the school safe.

The closure could affect students in Paris. With West Paris likely to send its students to Paris Elementary School, some Paris students might have to be bused to other schools in the district to keep enrollment in Paris under 450 students, the board noted.

By December, town officials were already considering vacating the complaint against the school district. The board met with its attorney in executive session during Monday’s meeting. Selectman Matthew Brackett moved to have the town withdraw from the lawsuit, and the motion passed 4-1 with only Christopher Summers voting no.

In a related move, the board appointed Patricia O’Brien to the ad hoc committee investigating SAD 17 budgetary practices. O’Brien is the first person appointed to the five-member committee, which will not begin work until there is a quorum.

In other business Monday, the board approved an updated job description for a corporal in the Police Department. A job description for captain was also approved. Police Chief Michael Ward noted that the position will likely save the town money since the position is salary, not hourly, meaning there is no time-and-a-half for overtime.

Joseph O’Brien and Roland Hebert were named to the Planning Board.

Additionally, selectmen approved a request by the Fire Department for a road toll fundraiser on Park Street on Feb. 15 from 6-10 a.m. and Feb. 23 from 1-4 p.m.
