PARIS – Two men on probation for gross sexual assault were sent back to prison Friday after appearing in Oxford County Superior Court. A third man was also put back behind bars for having hundreds of pictures of nude children.
Arthur L. Howes, 27, of Mexico was sentenced to nine months and one day for having contact with a girl under the age of 18. His probation prohibits that.
“He knew that would be a parole violation and he put himself in that position anyway,” said Assistant District Attorney Richard Beauchesne. “He knew it was serious.”
The sentence was set to be longer than nine months, so Howes could serve it in a Department of Corrections facility, rather than the Oxford County Jail.
Howes received a 10-year sentence, with all but two years suspended and six years of probation, in April 2001 in a plea bargain agreement reached while the jury was in its second day of deliberation.
He was facing five counts of gross sexual assault.
Sean L. Andrews, 19, of Center Lovell received a year in jail for having sexual contact with a minor on April 20. Terms of his probation forbid him from having contact with a girl under 16 years old.
He was sentenced Jan. 23, 2002, to two years in jail with all but 120 days suspended and two years probation for gross sexual assault.
Beauchesne said the state could have asked for Andrews to serve 16 months in jail but decided that a year would be fine.
“I know he’s going to New Hampshire when he finishes his jail time here to do three and one-half more years for a similar charge,” Beauchesne said after the proceedings.
Paul R. Phillips, 51, of Waterford received a sentence of one year, with all but 14 days suspended, and one year probation for possessing photographs of nude children.
“He had hundreds and hundreds of pictures of naked little kids,” Beauchesne said.
The prosecutor said probably only two of them could be determined lewd by a jury. He said his office wanted Phillips on probation to keep an eye on him. Phillips was convicted of gross sexual assault in 1992.
