LIVERMORE FALLS – The town’s Board of Appeals declined to hear Wayne A. Parker Jr.’s appeal Monday afternoon after finding it had no jurisdiction over the appeal that was neither signed nor dated. Its decision will be sent to Parker in written form.

Parker was appealing the Planning Board’s Sept. 1 decision to not consider his site plan review application for an adult book and video store. The board said he could show no legal interest in the property where he planned to open his business.

He maintained he was rejected because of a typographical error, a misprint on the lease agreement with his father. Because of the error, the lease was good for one week, not one year, meaning it had expired even before the planners took up his application.

The board, acting on the written advice of the town’s attorney, Frank Underkuffler of Farmington, followed the town’s Board of Appeals ordinance before reaching the fourth step in the process, determining jurisdiction.

After the unanimous decision not to consider it, the board agreed that Parker’s next step in the legal process is to take his case to Superior Court.

Town Manager Alan Gove reported that two more citizens, Melissa Lovely and Tammy Greaton, had expressed interest in serving on the board and would bring it to its full size of five. Presently serving are Chairman Pam Cook, Vice Chair Maxine Bailey and Secretary Betty Nadeau. Flora Jones, a former member, had asked to resign.
