JAY – A Jay man pleaded guilty to felony bail violations and misdemeanor counts of unlawful sexual contact and assault involving a 6-year-old girl. In all, Tony J. DeMillo, 31, was sentenced to nearly six years in jail with all but nine months suspended and four years’ probation.

DeMillo has to register as a sex offender for 10 years.

Jury selection was expected to proceed Monday morning for the trial, but Silva instead changed his not-guilty pleas to guilty in a plea agreement, Assistant District Attorney James Andrews said Monday.

DeMillo had initially been indicted on felony charges of gross sexual assault and unlawful sexual contact.

The victim’s mother became “completely uncooperative” with the district attorney’s office, Andrews said.

The victim’s mother refused to bring in the child to prepare for trial, and she took the child to South Carolina and is no longer in the state, Andrews said.

The felony bail violations occurred in January, Andrews said, after DeMillo repeatedly made telephone calls to the victim’s mother.

For the bail violations, Justice Joseph Jabar sentenced DeMillo to five years with all but nine months suspended, and two years’ probation, Andrews said.

He was sentenced to 364 days, fully suspended, with two years’ probation on the unlawful sexual contact and assault charge, Andrews said.

DeMillo also has to undergo sex offender counseling and have no contact with children under 16 and no contact with the victim.
