LEWISTON – A local couple blames their landlord’s negligence for a fall that sent their 22-month-old son to the hospital.

Abdiza Ali and Amina Nuh have filed a lawsuit against Ashmont Associates, seeking money to cover their son’s medical expenses and to compensate him for his pain and suffering.

The fall happened more than two years ago, while the family was renting a second-floor apartment at 50 Fairmount St. in Lewiston. The building is owned by Ashmont Associates and managed by PropSys.

According to a lawsuit filed in Androscoggin County Superior Court, the couple informed the building’s property manager several times that the window in the front bedroom could not be securely latched.

Despite promises to address the problem, no one ever showed up to fix it, the suit says.

The couple’s son – one of five children – fell from the window on May 27, 2003. He was rushed to a hospital in Portland, where he was treated for his injuries and examined for a head injury.

The boy eventually recovered fully, according the couple’s lawyer, Justin Leary.

Representatives for PropSys and Ashmont Associates could not be reached for comment.
