MARS HILL (AP) – A tax credit that could bring a wind energy project to fruition in northern Maine has been included in the final federal energy bill, Sens. Olympia Snowe and Susan Collins say.

Evergreen Wind Power LLC has been waiting on the tax incentive before starting construction of 30 wind turbines in Mars Hill.

The credit would provide renewable energy producers with a benefit for 10 years. To qualify, wind and biomass operations would have to complete construction between the beginning of 2006 and the end of 2008.

Justice dismisses tax charges

PORTLAND (AP) – A Superior Court justice has dismissed tax evasion charges against two Maine Maritime Academy graduates, ruling that the state’s definition of residency is unconstitutionally vague.

Justice Roland Cole on Tuesday threw out charges against Michael Falcone and James Jannetti, who were indicted last year for failure to pay income taxes and tax evasion between 1997 and 2002.

In a motion to dismiss, defense attorneys said the state’s definition of “domicile” was unclear, making tax decisions difficult for merchant mariners who spend months at sea and split time between different states when they come ashore.
