AUGUSTA (AP) – A police officer and a sheriff’s deputy were legally justified in shooting and killing a man who fired at them after robbing a pharmacy and leading officers on a chase through several towns, Attorney General Steven Rowe said Monday.

Kim David Niedermann was hit in the neck and abdomen after he emerged from a stolen vehicle and fired on officers in a pizzeria parking lot in Brunswick on Nov. 17.

A review by the attorney general’s office determined that Sagadahoc County Sheriff’s Deputy Chad Carleton and Brunswick Police Officer Paul Hansen were legally justified in firing on Niedermann because they believed deadly force was necessary to counter an imminent threat against officers and bystanders.

The shootout capped a 90-minute drama that began with the armed robbery of a pharmacy in Waldoboro and included a chase reaching 100 mph and a carjacking.

After the burglary, Niedermann initially fled in a PT Cruiser that he eventually abandoned in Bath after it was damaged.

Then, he ordered a woman out of her Subaru at gunpoint, transferred items from his car and continued the chase to Brunswick.

Investigators determined that Niedermann fired nine shots total, three in a Bath parking plaza and six in the final exchange of gunfire in Brunswick, according to Chuck Dow, spokesman for the attorney general’s office.

The two officers fired a total of six shots from their .40-caliber handguns. Carleton also fired once with a shotgun before pulling out his pistol.

Police later determined that Niedermann had in his possession four firearms, seven knives, a stun gun and more than 300 rounds of ammunition.

Slugs from Niedermann’s 45-caliber handgun struck several police cruisers, and one of them struck Carleton’s equipment belt, sending fragments into his pants, sweater and T-shirt. Carleton, who was wearing a bulletproof vest, was not seriously hurt.

During the chase, shots were fired at officers who were pursuing Niedermann’s vehicle, officials said.
