WILTON – The Appeals Board will meet Thursday to hear an appeal by resident Kathleen Masterman, who says the Planning Board erroneously approved a five-lot subdivision off Village View Road.

As an abutter of the proposed subdivision, Masterman has said she thinks board members made “procedural errors as well as errors in judgment.” She said the property, which runs along an embankment leading down to Wilson stream, is prone to erosion and could be affected when people build there. She also fears the septic systems that Adam Mack, owner of the proposed subdivision, plans for the lots could leach into the ground.

In her formal appeal, Masterman also said said the Planning Board erroneously waived a town ordinance that requires subdivisions to have only one entrance and exit to the main road.

When board members voted 4-3 to permit the subdivision in January, they did so by waiving the ordinance and finding in favor of Mack. He said the layout of the subdivision makes it nearly impossible to build a separate road for the five lots. Mack also said the cost of building a road just for the subdivision would be an economic hardship.

The landowner had originally proposed a separate entrance for each lot. But, after the board rejected that proposal, he reduced the five entrances to three, at which point the board waived the ordinance and approved Mack’s permit application.

Appeals Board member Norman Gould said Tuesday that the board will establish Thursday “whether in our estimation the Planning Board had the authority” to waive the ordinance.

Board members will also hear an issue about a cabin off the Tobin Flat Road and about a carport built in violation of town ordinances on Lyle Hall Road, said Gould.
