AUBURN – A Massachusetts man accused of having sex with a 13-year-old Auburn girl he met in an Internet chat room was ordered held at the Androscoggin County Jail Tuesday on $5,000 cash bail.

Matthew Gulino, 23, is charged with gross sexual assault.

Gulino told police he asked the girl during their online chat last week whether she was 16 and she said she was, according to an affidavit filed in Androscoggin County Superior Court. He posed as a 19-year-old named Jason.

He picked her up at her Auburn home and drove her first to a friend’s house, police said. Later, the pair drove to Sabattus, parked at an “off-road trail” and had sex in his car, according to the affidavit.

Gulino later told police he had used a condom, which he tossed from his car before they drove away.

Gulino told police he did not realize the girl was 13 until he received a telephone message from her mother, according to the court document.

Gulino was stopped by police as he headed home along I-95. He agreed to speak with Auburn police and showed investigators his laptop computer, which still contained the online conversation he had had with the girl.

According to the court document, the chat session showed that Gulino asked the girl if she wanted to “hook up” for sex. The girl replied that she did. The chat dialogue also shows Gulino asking the girl if she was 16, to which the girl responded that she was.

The girl told police that the sex was consensual, but that she had thought Gulino was 19, according to the affidavit.

Police seized Gulino’s computer and two unopened condom packages as evidence in their case against him.

Guilino’s bail conditions – if he raises the $5,000 – include no going to Internet chat rooms, no using Internet instant message programs, no downloading or viewing Internet porn, and no contact with kids under 18, except for family members.
