AUBURN – The trial of Lewiston Mayor Lionel Guay on sex-related charges is expected to start Monday.
Guay, 65, faces three counts of unlawful sexual touching and four counts of assault stemming from allegations by a teenager who was a high school senior at the time of the alleged encounters.
She said Guay touched her breasts on Feb. 11, 2005, touched her buttocks “on numerous occasions” a month later and kissed her on the mouth on Sept. 26 last year. Each charge states the action was taken “for the purpose of arousing or gratifying sexual desire.”
Each of the charges is a class D misdemeanor and carries penalties of up to a year in jail and a fine of up to $2,000.
Guay has publicly denied the charges and asked for a jury trial. His attorney, Jennifer Ferguson of Lewiston, said the Attorney General’s Office rushed the investigation, formally charging Guay one week before he stood for re-election to a second two-year term. He won easily.
She said her client was ready to present investigators with documents showing a history of the girl’s “dishonesty.”
Six men and six women will serve as the jury during the trial, which is expected to take up to three days in Androscoggin County Superior Court. During jury selection, a judge read through a lengthy list of potential witnesses. One witness who was subpoenaed by the defense appeared before the judge saying she couldn’t make it to the trial because she would be in college without a car. The judge said she had to be there.
Pre-trial wrangling included debate over which information should be shared with prosecutors and which evidence should be allowed at trial, including work time cards that covered the period over which the alleged criminal action took place. An appeal of one of those motions landed on the bench at the Maine Supreme Judicial Court, which turned away the appeal, calling it premature.
Lawyers on both side have kept mum about their respective trial strategies. A recent hearing on last-minute motions was held behind closed doors.
