PORTLAND – The recount in House District 102, which includes Standish, is over, but the results are still in dispute.

After meeting for a second day, Democrat Michael Shaw and Republican Rep. Gary Moore were unable to agree on the outcome of the election.

It will now head to the House Election Committee and the Legislature, where the matter will be ultimately resolved.

Initial, unofficial results from Election Day showed Shaw winning the race, 1,601 to 1,588. Moore requested a recount, which was conducted Nov. 20. After the recount, Moore appeared to take the lead in the race. The number of ballots counted, however, exceeded the number of people who voted by 66. Because of the discrepancy, the race was unresolved.

“This is far beyond any usual margin of error,” said state Rep. Glenn Cummings, the incoming speaker of the House. “We take every vote seriously. Out of fairness to voters, we will take a closer look at this election to determine what happened and to make sure that we honor the democratic process with accurate results.”

The Election Committee will review the results, and a final decision will be made by the House of Representatives. If the matter is not resolved before new members are sworn in on Dec. 6, Shaw will be conditionally seated pending the outcome of the review.

According to Cummings office, Republicans are contesting the results of the race in House District 7, which includes part of Aroostook County. There, Democratic challenger Pat Sutherland was the apparent winner on election night, beating Republican incumbent John Churchill by four votes. Churchill is challenging both the election results and the recount findings, also sending that race to the Elections Committee.

A recount in House District 121, which includes Cape Elizabeth, confirmed Monday that Democrat Cynthia Dill defeated Republican Jennifer Duddy.

Also on Monday, a recount confirmed that Democrat Benjamin Pratt of Eddington defeated Republican Darren Hall of Holden in House District 20.
