LIVERMORE – Selectpersons meeting Monday discussed problems with a non-conforming structure on Keith Street.

The building is located within 25 feet of the property line. The owner had obtained a permit to expand the structure, but instead, it was moved and a new, larger structure was constructed.

A neighbor complained that the roof of the structure is so close to the property line that rain and snow runoff falls onto the neighbor’s property. The neighbor also said that this is creating an erosion problem on Brettuns Pond.

Both parties have gone to the Planning Board, which will visit the site today and render a decision possibly at its Dec. 19 meeting.

“If the building has to be removed, the owner has one year to appeal to the Planning Board,” said Administrative Assistant Kurt Schaub. “If the building is approved, the neighbor can appeal the Planning Board’s decision,” he said. “After that, they can go to the Superior Court.”

Selectpersons also discussed the Time Warner cable TV franchise renewal. Time Warner has been reviewing maps of the town to determine cable access. Jay, Livermore and Livermore Falls have also discussed school courses to be offered to students via local access channel 7.

Because of some changes in the franchise agreement, some selectpersons were not in favor of renewing it. “The expiring Adelphia agreement would provide cable access to roads with 15 houses per mile, or eight houses per half mile. The new Time Warner agreement is based on 25 houses per mile and homes located within 150 feet of cable access roads,” Schaub said.

“They knew when they signed the contract that this was a rural town. If they wanted 25 houses per mile, they should never have signed it,” said Chairperson Grace Jacques.

“I will never agree to a contract requiring 25 houses per mile,” said Selectperson Brenda Merrill.

Selectperson Wayne Timberlake asked, “Does this new agreement include adding so many miles of cable per year?”

Schaub will look into what can be done to get the expansion issue resolved.
