FRYEBURG – The Planning Board will consider whether the land use of a proposed truck-filling facility would constitute a low-impact business, according to Code Enforcement Officer Boni Rickett.

Rickett said the Planning Board met Tuesday night to educate newer members about the controversial proposal and decide how to proceed with the issue, which was returned to the town from the Maine Superior Court.

Rickett estimated between 20 and 30 people showed up at the meeting.

“It was a working meeting,” said Rickett. “The public did not speak other than the two parties involved. Their attorneys did speak to some procedural issues.”

Nestle Waters North America Inc., which owns the Poland Spring label, wants to build a $2.1 million facility on Route 302 that would fill trucks with water tapped from a Denmark aquifer. The facility would be open 24 hours a day and fill a maximum of 50 trucks daily.

The project is opposed by Western Maine Residents for Rural Living, which argues that the proposed facility would violate the town’s zoning ordinance. Residents have also expressed concern over the amount of traffic the facility would generate.

Last year, the Board of Appeals overturned a permit issued to Poland Spring by the Planning Board. The matter went to the Oxford County Superior Court, but, like the more recent decision by the Maine Superior Court, it was remanded to the Planning Board.

Rickett said Gene Bergoffen, the chairman of the Planning Board, forwarded a resignation at the Planning Board’s Oct. 9 meeting, but the resignation has not officially been accepted. At that meeting, the board recused Bergoffen from participating in Tuesday’s discussion.

Rickett said attorneys were mainly concerned with issues related to a Nov. 1 meeting, in which both Nestle Waters and the Western Maine Residents for Rural Living will present their cases before the Planning Board.

Rickett said the meeting will take place at 7 p.m., though a location has not been confirmed.
