PARIS – Two men were held without bail at the Oxford County Jail on probation violations Wednesday.

Justice Robert E. Crowley ordered Joshua Westberry, 22, of 282 Paradise Road in Bethel, and Jason Mark Merriam, 26, of 25 Main St., Sumner, to remain at the jail pending resolution of motions to revoke their probation.

Westberry pleaded guilty in 2005 to 11 burglary counts after being indicted for 21, plus 20 counts of criminal mischief, and six counts of theft in connection with break-ins in Denmark.

Westberry was ordered to serve two consecutive six-month jail terms on two of the charges and pay $6,397.83 in restitution. He was also given a fully suspended five-year prison sentence with three years probation.

The latest motion to revoke Westberry’s probation charges him with failure to report to his probation officer in May and June and failure to pay restitution and supervision fees. Westberry denied the allegations.

Defense attorney Ron Hoffman said Westberry is employed and will not be able to pay the fines in jail.

Merriam turned himself in at the jail earlier this month on charges of kidnapping, aggravated domestic assault, domestic assault, terrorizing, criminal threatening and stalking. Merriam’s girlfriend accused him of threatening to kill her, slamming her head against a car and attempting to strangle her several times.

Assistant District Attorney Richard Beauchesne said Merriam is on probation for a theft charge, for which he received a fully suspended six-year prison sentence. Beauchesne said the charges were “incredibly serious,” and that Merriam has a history of violent behavior.

Defense attorney Sarah Glynn said the incident marks Merriam’s first probation violation and argued that he should be released with conditions.

Crowley also ordered Neil Severy, 31, of 140 Main St., Fryeburg, to serve 30 hours of community service for his first probation violation. Severy was sentenced in May 2003 to serve four years of an eight-year prison sentence and pay $5,000 restitution for an aggravated assault charge.

In August, Severy was arrested by Fryeburg police for theft, operating without a license and attaching false plates.
