LIVERMORE – The town followed proper posting procedures for an Oct. 24 special town meeting for voters to consider a dangerous dog ordinance, the town’s attorney said Thursday.
Peter Drown Jr. of Livermore filed a civil lawsuit in an Auburn court claiming the town didn’t follow state statutes in posting the warrant. He also claims there was no proper return on the warrant for the vote on the dog ordinance.
The ordinance strengthened the town’s position when dealing with court-declared dangerous dogs.
Drown claims the ordinance adopted in a 34-19 vote is invalid and represents an unlawful exercise of authority. He wants the court to declare it null and void.
“The complaint alleges that the town’s dangerous dog ordinance is invalid because proper notice was not given for the town meeting at which the ordinance was adopted,” town attorney Lee Bragg said. “The constable’s return shows that the statutory requirements were met, and I therefore do not believe that the complaint has any merit.”
