Under the Employee Freedom of Choice Act, which is supported by U.S. Rep. Tom Allen, a union would be automatically certified as the sole bargaining representative for a workplace once a simple majority (51 percent) of its employees sign cards.
There is no “choice” involved, and no election need be held. Rather, the only time any “choice” creeps in is when less than a majority (but at least 30 percent) of workers sign cards expressing interest in a union; the union organizers (not the workers) can choose either holding a private election or pursuing certification through the card check system.
However, union organizers would almost never call for a private election without signed cards from a majority of workers. AFL-CIO studies reflect that unions win only 8 percent of elections called after less than 40 percent of workers have signed cards. Rather, this bill is clear political pandering by the Democrats.
Each union certified means more union dues, which means more money to funnel to candidates who support such misguided legislation.
“Instead of providing a voice for the unheard, EFCA risks silencing those who would speak … There have been many documented cases where workers have been pressured, harassed and tricked and intimidated into signing cards that have led to mandatory payment of dues much of the congressional support is based on a desire to give our friends among union leaders what they want.”
