FARMINGTON – A Jay man accused of shooting at police in a 2006 incident at his home was ruled incompetent to stand trial in Franklin County Superior Court on Tuesday.

William C. Burhoe, 53, 309 Macomber Hill Road, pleaded not guilty to aggravated attempted murder and reckless conduct after the June 2006 incident. He was indicted by a grand jury in U.S. District Court in September 2006 on a charge of possession of a firearm after a mental health commitment. He was transferred to federal custody in October 2006 for disposition of the federal charges prior to a trial on the pending state charges. He has remained in federal custody since.

Based on federal medical reports, Justice Michaela Murphy made the ruling in the Farmington court, which keeps Burhoe in federal custody to undergo treatment to see if competency can be restored.

The state will ask for reports that update his progress on whether he will eventually be ready to stand trial on the charges.

When police responded to a call at Burhoe’s home for a domestic dispute in June 2006, Burhoe fired his gun at them, Maine Department of Public Safety spokesman Stephen McCausland said at the time. State Trooper Randy Keaten ended the confrontation by shooting Burhoe in the leg. Keaten was cleared of any wrongdoing by the Maine Office of the Attorney General.
