COLEBROOK, N.H. (AP) – A Vermont man accused of fleeing to New Hampshire after the shooting death of his mother continues to be held without bail and will be evaluated by the state psychiatrist.

Police say Kenneth Heath, 59, was arrested without incident after crossing the Connecticut River after the death of his mother in late September. He is expected to face a charge of second-degree murder, but his return Vermont has been delayed by claims that he is not mentally competent to waive extradition.

At a hearing this week, Heath’s lawyer argued that he should be released on bail on the fugitive from justice charge but prosecutors successfully argued that he is a flight risk.

Another hearing is set for Nov. 20.
