PORTLAND (AP) – A 41-year-old man who lost his right arm in a police shooting at his home in Sebago says an audio tape obtained from prosecutors is the basis for his claim that officers used excessive force.
The tape is part of the criminal case against Douglas Tenczar, who is charged with criminal threatening with a firearm last October when deputies arrived to investigate a road rage complaint in which he allegedly flashed a gun.
Tenczar’s lawyer, Thomas Hallett, told the Portland Press Herald that the tape shows that officers failed to identify themselves and that his client acted properly in grabbing a shotgun to defend himself.
Tenczar filed notice of his claim Tuesday with the Cumberland County Sheriff’s Office.
